Statement by Nicholas Gotsell MP – DA NCOP Member on Security & Justice:
The Democratic Alliance (DA) welcomes the direct imprisonment sentence handed down to the 17-year-old convicted of the brutal rape and murder of a tourist in Ladismith.
The Child Justice Act rightly places rehabilitation, diversion and reintegration at the centre of how children in conflict with the law are dealt with. However, the Act also allows for direct imprisonment in serious cases involving children over the age of 14, where the court finds that the offence, the circumstances and the interests of justice demand it.
This is one such case.
South Africa is seeing a deeply worrying increase in serious and violent crimes committed by minors. While every child offender must be dealt with within the framework of the law, society cannot ignore the devastating impact of violent crimes on victims, families and communities.
The DA remains grateful for the important role played by the Western Cape Department of Social Development in providing services and programmes to sentenced children. Rehabilitation must remain part of the justice process, but accountability must never disappear.
This sentence sends a clear message: age alone cannot shield a young offender from serious consequences where the crime is grave, violent and destroys lives.
