BCMDA Board Appointed ‘Irregularly’

The DA has submitted a Promotion of Access to Information Act (PAIA) application after the Buffalo City Municipal Council’s irregular appointment of the new Buffalo City Metropolitan Development Agency (BCMDA) board.

At a council meeting held on Thursday, 29 June 2023, the ANC-led council irregularly pushed through the appointment of a board that now includes convicted fraudster and former Buffalo City mayor Zukiswa Faku.

A number of irregularities took place in appointing the board. These are:

  • The report regarding the board appointment was only submitted to the opposition councillors on the morning of the council meeting. Opposition councillors were, therefore, not given the time to perform the necessary due diligence to ensure that a competent BCMDA board is appointed.
  • The report does not comply with the prescripts of the Municipal Systems Act, which states that the board of directors must have the requisite range of expertise to effectively manage and guide activities of the municipal entity and that a list of applicants and any prescribed particulars concerning applicants is compiled to allow Council to make an appointment.

Both statutory requirements were not dealt with. Council was only provided with a list of persons already appointed. Council is, therefore, not aware if other candidates were more suitable, as we don’t know who else applied.

The DA has now submitted a PAIA application to the Buffalo City Municipality to access records of the selection panel on how the appointees were selected, the names of the other applicants and their qualifications.

This is another classic example of ANC cadre deployment at its worst, where individuals are appointed to positions of power without the necessary accountability and outside of existing structures. It is also a travesty of justice that a convicted criminal has been appointed to a senior position of trust within a municipal entity.

The DA will not falter in its fight against cadre deployment and corruption in Buffalo City. Residents deserve a DA government that will ensure good clean governance and excellence in service delivery.
