The labour department has agreed to a court order confirming that it has no authority to grant clothing manufacturers a grace period or amnesty for failing to comply with labour laws.
The National Bargaining Council said some Newcastle factories refused its inspectors access.
The factories claimed they were protected by an 18-month department compliance pilot project.
The factories did not agree to the court order and will return to the labour court on 12 October.
