South Africa Needs an Independent Anti-corruption Commission

Statement by Adv Glynnis Breytenbach MP – DA Spokesperson on Justice and Constitutional Development:

The Democratic Alliance notes the proposals announced yesterday by the Minister of Justice and the National Director of Public Prosecutions aimed at strengthening the Investigating Directorate Against Corruption (IDAC).

While any genuine attempt to improve South Africa’s capacity to investigate and prosecute serious corruption is welcome, the measures announced simply do not go far enough. They seek to repair an institution whose credibility has been fundamentally undermined by the deeply disturbing evidence emerging daily before the Madlanga Commission.

The reality with which we are faced is that the systemic failures now being exposed did not arise overnight. They flourished under the noses of the very leadership now proposing reforms. If allegations of improper relationships, compromised investigative processes and interference are borne out, they reveal institutional failures that should have been detected and addressed long before they reached this point. The entire organisation is irreparably tainted. No one raised the alarm, no one refused an illegal instruction. This is an organisation that cannot be rehabilitated.

This crisis also cannot be viewed in isolation. Over the past several years, the criminal justice system has witnessed an alarming procession of senior officials being suspended, dismissed, forced to resign, subjected to disciplinary proceedings or criminal prosecution across key institutions responsible for combating crime and corruption. From the NPA to Crime Intelligence, the Hawks and now IDAC, the pattern is unmistakable. These are not isolated incidents—they are symptoms of a criminal justice system suffering from deep institutional decay.

Adding more resources, refining procedures or making administrative adjustments cannot restore public confidence where the institution itself has become fatally tainted. South Africans deserve an anti-corruption body that is beyond reproach, independent of political influence and structurally insulated from the failures that have brought IDAC into disrepute. A body that will be effective, efficient and produce the goods.

The DA has consistently argued that South Africa requires a genuinely independent Anti-Corruption Commission, established in accordance with the Constitution and enjoying the institutional and operational independence necessary to investigate and prosecute grand corruption without fear, favour or prejudice. Such a body should have secure tenure, protected funding and robust parliamentary oversight to ensure both independence and accountability.

The revelations emerging from the Madlanga Commission should serve as a watershed moment. They demonstrate that merely attempting to reform IDAC is unlikely to restore the public trust that has been lost. South Africa needs more than institutional repairs; it needs institutional renewal. IDAC was formed as the band aid for the woes of the NPA, no band aid is going to fix this mess.

The fight against corruption is too important to be entrusted to a body whose integrity has been so seriously called into question. The country cannot afford another cycle of promises followed by disappointment. Every successive suspension, dismissal and prosecution of senior criminal justice officials has further eroded public confidence in institutions that are meant to uphold the rule of law. It is time to break that cycle by establishing a genuinely independent Anti-Corruption Commission capable of restoring confidence in the criminal justice system and ensuring that no individual is above the law.
