JOHANNESBURG, Gauteng: Specialist legal firm Executor Law has released an industry-focused advisory examining the procedural bottlenecks that commonly delay the finalization of deceased estates in South Africa. The publication serves as an educational resource for executors and beneficiaries, outlining actionable steps to navigate the bureaucratic requirements of the Master of the High Court and SARS efficiently.

Navigating Initial Regulatory Requirements

The prompt administration of deceased estates relies heavily on the accuracy of the initial reporting phase. The newly released guide details how incomplete applications for Letters of Executorship frequently cause immediate, months-long delays. The Master’s office operates strictly on regulatory compliance; submitting a copy of a will rather than the original, or failing to provide properly formatted inventories, triggers formal requisitions that halt all progress. Executor Law emphasizes that gathering correct, original documentation immediately following a death is the most critical step in saving time.

Resolving Complex Tax and Property Matters

A core focus of the advisory is the intersection of estate administration and tax compliance. Under South African law, an estate cannot be distributed until SARS issues a final compliance status. The guide explains that resolving historical tax non-compliance, business taxes, or complex capital gains calculations can significantly extend the administration timeline.

Additionally, the publication addresses the complexities of immovable property. Transferring a house requires a municipal rates clearance certificate and formal processing through the Deeds Office. Executor Law advises families to proactively flag any property disputes, unapproved building plans, or outstanding municipal arrears early in the process to prevent the property transfer from stalling the entire estate.

Mitigating Beneficiary Disputes

The advisory also warns against the delays caused by internal family conflict. Under Section 35 of the Administration of Estates Act, any interested party may lodge a formal objection to the Liquidation and Distribution Account. Even a single objection immediately halts the distribution of funds to all heirs until the Master resolves the dispute. The firm encourages transparent communication among beneficiaries and the swift appointment of independent, specialized legal counsel to manage grievances objectively.
