Operation Shanela nets more than 900 suspects in the Free State

Operation Shanela has nabbed 967 suspects in the Free State last week.

Police in the province say 50 suspects were arrested for possession of drugs, with nine being arrested for rape, four for murder and 14 for attempted murder, while 28 were arrested for possession of dangerous weapons.

Twenty-one suspects were arrested for property crimes; 45 were arrested for malicious damage to property and 107 were arrested for assault with intent to cause grievous bodily harm.

In Virginia, on 26 June 2024, members of Crime Intelligence provided information on two suspected vehicles seen around petrol garages.

Three suspects were arrested after an illegal firearm was found in the vehicle in which they were driving. The second vehicle, a VW Golf, was traced and found with three occupants, and a firearm was also found and confiscated.

In another incident, a vehicle was traced and stopped. All three males found in the vehicle were also arrested after a 9mm firearm was found and confiscated.

In Rouxville, one foreign national was arrested after his bakkie was stopped at a roadblock and while the police were searching the vehicle, they found boxes of illicit cigarettes worth an estimated R12 million.

In Springfontein, two males, aged 23 and 25, were arrested after they were stopped by highway patrol on the N1 and dagga worth an estimated R1.7 million was found in the back of their bakkie.

In Batho, an illegal foreign national was arrested after he was found with an unlicensed firearm. This is after police received information that the suspect might have been part of a group that robbed a tuckshop.

Detective tracing operations, as part of Operation Shanela, saw more than 215 suspects, who did not have the legal documents to be in South Africa, being taken to Home Affairs for further handling.

Thirty-three people were arrested for driving under the influence, while 253 drivers were fined for contravention of the Traffic Act.

Operations are continuing throughout the province and community members are urged to continue providing information on crimes taking place, and to work with police to identify possible suspects. – SAnews.gov.za

Eskom-owned transmission company officially commences trading

Location: News

Eskom-owned transmission company officially commences trading

The National Transmission Company South Africa (NTCSA) has officially commenced trading, marking the company’s establishment as a distinct and wholly owned subsidiary of Eskom.

The move is a also a significant step in the reform of South Africa’s electricity supply industry.

This is according a joint media statement released by Eskom, the NTCSA and the Department of Public Enterprises.

Eskom Board chairperson Mteto Nyati said the entity will focus on adding capacity to South Africa’s power grid.

“We are pleased to announce that NTCSA begins trading today and will focus on increasing the capacity of the national transmission grid to allow the connection of much-needed new power generation capacity.

“As a wholly owned subsidiary, it will operate under the direction of an independent board while providing open access to the electricity network, as envisaged during the unbundling process. We look forward to contributing to a more efficient and transparent electricity industry,” he said.

The NTCSA board chairperson, Priscillah Mabelane, said that together with the relevant departments, the entity is embarking on an important journey.

“As we embark on this exciting and critical journey, our commitment is to continue focusing on ensuring safe, reliable, and efficient operations while accelerating the development of an interconnected transmission system in line with our mandate.

“We will ensure non-discriminatory access to the transmission network and seek ways to accelerate the rollout of the transmission grid while fostering transparency and efficiency. Together, we look forward to shaping a dynamic electricity market.

“We extend our deepest gratitude to our team, Eskom, Inter-Governmental Steering Committee comprising of Department of Minerals and Energy, National Treasury and the Shareholder Representative, DPE for their immense support in achieving this pivotal milestone,” Mabelane said.

About the NTCSA

According to the joint statement, the entity will “own and operate the country’s national transmission system, the world-class System Operator, the grid strengthening function, energy market services and the International Trader”.

The benefits of legal separation from Eskom are as follows:

  • A competitive electricity market.
  • An open access to the transmission network.
  • Enhanced efficiency and promoting transparency.

How the NTCSA will operate:

The NTCSA will operate under the three following licences issued to it by the National Energy Regulator of South Africa (NERSA):

  • The operation of transmission facilities by operating and managing the transmission grid.
  • Trading, in terms of which it will buy energy from Eskom generators and Independent Power Producers, as procured by the Minister of Mineral Resource and Energy.
  • Import and export in terms of which it will import and export energy, as well as continue as the trading arm to and from the Southern African Power Pool (SAPP)

“In terms of current legislation, NTCSA will play the role of the Transmission System Operator and buyer. It will assume additional roles once the Electricity Regulation Amendment (ERA) Bill is passed into law. The NTCSA will trade with Eskom Generation and Independent Power Producers (IPPs) using the current industry framework.

“The transition to a competitive electricity market will only commence after the ERA is gazetted, and NTCSA will assume the additional role of Market Operator. In this capacity, it will provide a platform for generators, consumers, traders, and retailers to trade with one another, as is the case in leading countries around the world.

“The establishment of the NTCA is another step in the electricity market structure reform, aiming to enhance efficiency and promote transparency. It will act as a catalyst for much-needed improvements and upgrades within the national electricity transmission infrastructure,” the statement read. – SAnews.gov.za

Border authorities arrest Lesotho nationals at Qashasnek

Border authorities arrest Lesotho nationals at Qashasnek

The Commissioner of the Border Management Authority (BMA), Dr Michael Masiapato has commended the interception of four Lesotho nationals who were in the country illegally and in possession of over R1.4 million in cash at the Qashasnek port of entry.

The arrests were made during a joint operation by the BMA, members of the South African National Defence Force (SANDF) and the South African Police (SAPS) after a vehicle was stopped for searching as part of routine check at a Vehicle Check Point (VCP) of a Bi-National operation between South Africa and Lesotho on 25 June 2024.

“Five Lesotho nationals were in the vehicle and four were found to be previously declared undesirable and had been banned from entering the country in terms of the Immigration Act. The above-mentioned persons were searched and found to be in possession of concealed South African currency worth R1 480 050.

“The four who did not have the requisite documents were arrested for being in South Africa illegally and a case was opened. The money which was counted, and underwent counterfeit verifications, was then deposited into the state bank account pending further investigations on the matter,” the BMA said on Saturday.

The Commissioner commended the crime prevention contributions of BMA officials at Qashasnek port of entry and their detection systems.

"As the Commissioner of the Border Management Authority, I am committed to ensuring the safety and security of our nation. To this end, we have adopted a zero-tolerance approach to criminal activities at our ports of entry.

“We will rigorously enforce the law and take decisive action against any illegal activities to maintain the integrity of our borders. The Junior Border Guards continue to display great effort in protecting our country. Their dedication and hard work are vital in maintaining the safety and integrity of our nation," Masiapato said.

Masiapato said that any individuals caught engaging in criminal behaviour, will face the full might of the law. –SAnews.gov.za

Court dismisses order to interdict NSFAS

Court dismisses order to interdict NSFAS

The Western Cape Division of the High Court has dismissed with costs, an application brought by Ezaga Holdings for an interim order to interdict the National Student Financial Aid Scheme (NSFAS) from reviewing and terminating its contract.

Ezaga Holdings is one of the service providers that has been disbursing allowances to NSFAS beneficiaries.

The application brought by Ezaga Holdings was seeking for an interim order to interdict NSFAS from taking steps in implementing the recommendations of the Werksman’s Report on the appointment of direct payment service providers to disburse allowances on behalf of NSFAS.

“The 12 June 2024 court order ruled there was no urgency to the application brought by Ezaga, while the review application to review and set aside Ezaga's contract is being finalised. The order comes after the Special Investigating Unit (SIU) successfully applied to be joined in the matter as a respondent.

“The SIU and NSFAS successfully argued that the matter was not urgent and fell to be struck off the roll for lack of urgency. The SIU and NSFAS welcome the decision of the High Court, as it clears the way for the implementation of investigation outcomes and consequence management to correct wrongdoings and further tighten the controls within the public procurement process.

“Noracco Corporation, one of the other service providers that have been disbursing allowances to NSFAS beneficiaries, was cited as a respondent in the matter. However, the company filed a counterapplication stating that they agreed with Ezaga Holdings' application; this was also dismissed with costs,” a joint statement by the SIU and NSFAS said on Friday.

The SIU’s investigation into the affairs of NSFAS found that the tender process followed to appoint student allowance dispensing service providers was allegedly irregular.

The SIU investigation probed the appointment of Coinvest Africa, Tenet Technology (Pty) Ltd, Ezaga Holdings (Pty) Ltd and Norraco Corporation as service providers to disburse student allowances.

“The SIU and NSFAS have applied to the Special Tribunal to review and set aside these contracts and to have the Tribunal declare them invalid and unlawful. The SIU and NSFAS also seek the service providers to be divested of all the profits they accrued due to the impugned tender awarded to them.

“The SIU is in terms of Proclamation R88 of 2022 authorised to investigate allegations of corruption and maladministration in the affairs of NSFAS and to recover any financial losses suffered by the State through corruption and negligence.

“The SIU is empowered to institute a civil action in the High Court or a Special Tribunal in its name, to correct any wrongdoing uncovered during both investigations caused by acts of corruption, fraud, or maladministration. In line with the Special Investigating Units and Special Tribunals Act 74 of 1996, the SIU will refer any evidence pointing to criminal conduct it uncovers to the National Prosecuting Authority (NPA) for further action,” the statement said. –SAnews.gov.za

NERSA approves applications for electricity tariffs

The National Energy Regulator of South Africa (NERSA) has completed considering the approving of all 178 licenced electricity distributors’ tariff applications for the 2024/25 financial year for effective implementation on 1 July 2024.

“NERSA processed the 2024/25 distributors’ tariff applications in line with the provisions of the Electricity Regulation Act and also in compliance with the High Court order in the Nelson Mandela Chamber of Business,” the Regulator said on Friday.

The applications were published on the NERSA website to solicit comments from affected parties, which were taken into consideration in the decision-making process.

Distributors were required to submit their tariff applications for the 2024/25 financial year based on their cost of supply studies.

Strengthening the fight against child labour

Location: News

Strengthening the fight against child labour

Children are the future, and it is our responsibility to ensure their safety and well-being by enabling them to grow and develop in a nurturing environment. The sad reality is that many children across the world face a daunting prospect of being drawn into work at a young age often under harmful conditions.

South Africa values the rights of children and has over the past 30 years sought to protect them from harm and promote their development. Protecting children from violence, exploitation and abuse is not only a basic right but an obligation set out in our Constitution.

This is in conjunction with other legislation such as the Children's Act and Basic Conditions of Employment Act which makes it a criminal offence to employ a child younger than 15 or children who are of school going age. The Children's Act also discourages children from working in mines, factories or in hazardous occupations.

In June, South Africa joined the international community in observing the World Day against Child Labour, under the theme: “Let’s Act on Our Commitments: End Child Labour”. The key commitments to end child labour are contained in the Durban Call to Action – a document adopted by various Member States, including South Africa at the 5th Global Conference on Ending Child Labour that was hosted in Durban in May 2022.  The document outlines strong commitments to end child labour through making decent work a reality, ending child labour in agriculture, strengthening the prevention and elimination efforts, realising children's rights to education, achieving universal access to social protection, and increasing financing as well as international cooperation. It is in this regard that this year’s commemoration raised awareness against child labour practices across the world and promoted initiatives to help put an end to this scourge.

In marking the day on 12 June 2024, our country reaffirmed its commitment in the fight against child labour. The day also coincided with the 25th Anniversary of the Adoption of the Worst Forms of Child Labour Convention which sets out to protect children against all forms of child labour. It also aims to prevent the use of children in armed conflict, prostitution, pornography, drug trafficking and participating in hazardous work.

The commemorations gave us an opportunity to reflect on the progress made as well as reaffirm our commitments to put an end to child labour. Despite the significant strides made over time to reduce child labour across the world, much still need to be done to fully eradicate the practice of child labour.

According to the International Labour Organisation (ILO), child labour has for the first time in 20 years increased globally. It is noted that the agricultural sectors such as farming, fishing, aquaculture, forestry and livestock farming account for 60 percent of child labourers aged five to 17 years.

In our fight against this plight, South Africa has endorsed the United Nations Convention on the Rights of the Child in 1995 and the African Charter on the Rights and Welfare of the Child in 2000 to affirm its commitment to the realisation of children’s rights.

In addition, the Department of Employment and Labour in collaboration with the International Labour Organisation launched the Prevention and Elimination of Child Labour in South Africa project to prevent and eliminate any forms of child labour in the agricultural sector in the country. The project is being piloted in the Western Cape and KwaZulu-Natal.

Delivering the keynote address at the launch, former Minister of Employment and Labour Thulas Nxesi expressed concern on the increase of child labour in the agricultural sector.

He said: “The agricultural sector is the backbone of our economy, providing food security and sustenance, as well as livelihood to millions. Yet, it is disheartening to note that some of the very hands that cultivate the crops and tend to the livestock belong to children who should be in schools, not in the fields. This situation is unacceptable and demands our immediate attention and concerted efforts.”

Despite our best efforts to protect children from abuse, neglect and exploitation, many children remain vulnerable. Tackling the scourge of child labour requires interventions on many fronts, and it is a reality that government on its own cannot curb.  As such, businesses have a responsibility to the elimination of child labour by carrying out due diligence in their operations and supply chains and ensuring responsible and sustainable business practices that address the root causes of child labour.

Let us all work together to prevent and eliminate child labour by reporting such acts of crime to the Department of Employment and Labour, or alternatively to the police.

Suspect accused of tampering with Eskom infrastructure gets five-year sentence

Suspect accused of tampering with Eskom infrastructure gets five-year sentence

The Mthatha Specialised Commercial Crime Court has sentenced John Tazvivinga to five years for tampering with Eskom infrastructure.

According to Eskom, the conviction stems from an incident, which occurred between 2015 and 2016, where Tazvivinga falsely represented himself as an Eskom contractor to Marhambeni residents in Mthatha, Eastern Cape.

“Under this pretence, he was hired by residents to connect electricity, for which he received R120 000.

“Tazvivinga unlawfully and intentionally tampered with essential infrastructure by illegally connecting electricity without authorisation from Eskom between 20 January 2016 and 15 April 2016,” an Eskom statement read.

The power utility said it suffered financial prejudice amounting to R231 000 as a result.

On Wednesday, the court found Tazvivinga guilty of contravening Section 3(1) of the Criminal Matters Amendment Act 18 of 2015.

Tazvivinga, who is a former consultant at Inkitha Royal Empire Construction, was sentenced to five years in prison, with the sentence wholly suspended for five years, provided he did not commit a similar offence during the suspension.

The company was ordered to pay a R10 000 fine.

Eskom’s Acting General Manager for Security, Botse Sikhwitshi, said the organisation strongly condemns and will not tolerate any impersonation of its business and staff by anyone.

“We are thankful to the internal security investigations and the Specialised Commercial Crime Investigation teams for their collaborative efforts over the years.

“While the sentence may not be as severe as Eskom had hoped, it serves as a reminder to potential criminals contemplating tampering with critical infrastructure and stealing electricity, contravening Section 3(1) of the Criminal Matters Amendment Act 18 of 2015, which could lead to a maximum prison term of 30 years,” said Sikhwitshi.

Sikhwitshi said the conviction contributes to the gradual improvement of convictions, which have doubled in the financial year 2023/24 compared to the financial year 2022/23, increasing from 11 to 22 recorded convictions.

Eskom encourages members of the public to report unlawful activities, including illegal electricity sales and connections, fraud, and theft of coal, fuel oil, diesel, and copper cables.

Reports can be made anonymously through the Eskom Crime Line at 0800 11 27 22 or via WhatsApp at 081 333 3323. – SAnews.gov.za

SA: An impressive example for democracies

Location: News

SA: An impressive example for democracies

As the indelible ink used to register voters in the recent general elections has almost faded from the left thumb; work to move South Africa Inc forward has been moving ahead steadily.

Following the hotly contested 2024 National and Provincial Elections (NPE), which produced no outright winner, South Africa is traversing partially new ground with the possible formation of a government of national unity (GNU).

I say partially new ground because the country adopted a GNU following the historic elections of 1994 which saw everyone who was eligible to, cast their vote for the first time and the African National Congress (ANC) win the polls. The elections ushered in a new democratic dispensation as well as the decision to put in place a three-party GNU under President Nelson Mandela, despite there being an outright winner.

However, following the 29 May 2024 polls, no political party received an outright majority, necessitating consideration of a number of options, including a GNU which President Cyril Ramaphosa has described as “the beginning of a new era.”

President Ramaphosa said the first GNU was established to promote nation building and inclusivity from a racially divided past during a period of political transition.

While many are wondering what the new GNU will entail in detail, what is clear is that our 30-year-old democracy is growing and maturing.

In other parts of the world, an unfavourable elections outcome for a ruling party could very likely be met with violence and a disregard for organisations established under chapter nine of the Constitution, like the Electoral Commission. Additionally, this violence would be closely followed by intolerance and instability as uninvited guests to an already tumultuous party.

However, in South Africa’s case, the will of the people exercised at the ballot box, is being implemented through the GNU. And before we moan and complain about the time it is taking to announce the new Cabinet, we ought to appreciate the fact that lives have not been lost or disrupted because of the Constitution-provided right for adult citizens to vote in elections and to do so in secret. Dialogue and engagement have been the first port of call - a clear indication that our 30-year-old democracy is dependable, resilient and respected.

To date, we’ve seen the swearing in of Members of Parliament, the election of the Speaker and Deputy Speaker of the National Assembly;  the Chairperson of the National Council of Provinces as well as the election and inauguration of President Ramaphosa.

The President affirmed this in his first address to the nation as President of the seventh administration. In his address following his inauguration at the Union Buildings, the President said: “In their multitude, in voices that are many and diverse, the people of South Africa have voted and made known their wishes, their concerns and their expectations. They did not give any single party the full mandate to govern our country alone.”

While the election results were not fully favourable for all parties, the results have been largely accepted and this is evidenced through the 10 of 18 parties with seats in Parliament having signed the GNU’s Statement of Intent.

According to President Ramaphosa’s recent weekly newsletter, the Statement of Intent commits signatories to a set of foundational principles that include respect for constitutionalism, accountability, transparency and community participation in government, evidence-based policy and decision-making, professionalisation of the public service, integrity and good governance.

In addition, the election results are proof that voting is not a futile exercise. The act of making one’s X on a ballot goes a long way. It has the potential of changing the trajectory of the country.

While that stubborn indelible ink may have faded off the left thumb, its impact has not only been an eyesore for those with beautifully manicured fingernails, but has also produced a new valuable chapter in South Africa’s autobiography that we can learn from.

While this autobiography displays all the good, such as increasing enrolment in public universities from 494 356 in 1994 to over a million students in 2023, steadily edging closer to the National Development Plan’s target of 1.6 million enrolments by the year 2030, as well as the provision of social grants to the most vulnerable - the story also lays bare some ugly truths, such as the ongoing battle against inequality, gender-based violence and unemployment that continues to plague society.

Citizens should be proud of how far the country has come. Our Constitution has been stretched and tested. Yet, it is still standing. Our country has not descended into chaos.

Democratic South Africa’s manuscript may have its fair share of stains across its pages in history. What is clear however, is that it has not found itself under the thumb of undemocratic practises. As in 1994, when South Africa showed the rest of the continent and globe that a peaceful transition, together with an inclusive government is possible - again, 30 years later, we are shining the same light of hope for the rest of the world, as we begin our new era.   -SAnews.gov.za

African Development Bank expands urban support program to six new cities

Location: News
African Development Bank Group (AfDB)

The African Development Bank's (www.AfDB.org) Urban and Municipal Development Fund (UMDF) (https://apo-opa.co/4exYmAh) has expanded its African Cities Program to cover six new cities across the continent. The expansion, approved by the Fund's 13th Oversight Committee, will help bolster urban development and address critical challenges faced by rapidly growing African cities.

The newly included cities are:

  • Kolwezi, the Democratic Republic of Congo: mining town grappling with rapid urban growth and environmental issues.
  • Grand Nokoué, Benin: an economic hub with over two million inhabitants.
  • Buffalo City, South Africa: a coastal city prioritizing climate resilience.
  • Joal, Senegal: A medium-sized city focusing on integrating environmental and social issues into economic development.
  • Juba, South Sudan: Prioritizing essential services for a growing, vulnerable population;
  • Nouakchott, Mauritania: Planning to combine projects on climate resilience, urban mobility, and sustainable energy.

The Bank launched the UMDF in 2019 in response to growing demand from countries and cities for urban development support. It receives contributions from the Nordic Development Fund and the governments of Denmark, Spain, and Switzerland, as well as the Walloon Export and Foreign Investment Agency.

The Fund provides financial and technical assistance to national and local governments for improving governance, planning, and to prepare investments in sustainable urban development for more climate resilient, resilient, liveable and productive cities, underpinning national socio-economic development and poverty reduction.

UMDF will provide funding for each of the six cities over several months, including a detailed analysis of the strengths and vulnerabilities, especially regarding economic, social, climate, and gender issues. The goal is to identify transformative infrastructure projects that can attract public and private sector investments.

The committee also reviewed the Fund's progress and approved its 2024 work program, allocating over $4.7 million to identify and develop urban infrastructure projects and bring them to maturity.

Mike Salawou, Director of the African Development Bank's Infrastructure and Urban Development Department, committed to strengthening the Fund's operational effectiveness and capacity to mobilize more funding and partnerships for greater impact.

“The question of urban development is at the heart of the Bank's new ten-year strategy for 2024-2033, of which the Urban and Municipal Development Fund is a strategic implementation mechanism,” he emphasized. The Bank ten-year strategy 2024-2025 (https://apo-opa.co/3L73NIF) includes data and research from publications (https://apo-opa.co/3XEbJbS) financed by the Fund and its partners.

It is hoped that the Fund will act as a catalyst in boosting access of African municipalities to public and private finance, a priority defined by the President of the African Development Bank Group, Akinwumi Adesina, at the Africa Investment Forum (www.AfricaInvestmentForum.com) 2023 Market Days in Morocco.

The National Musuems of Kenya (NMK) and CityBlue Hotels (CityBlue) (www.CityBlueHotels.com) are proud to announce a new partnership to co-promote tourism and culture in Kenya.

This alliance marks an exciting opportunity for sponsorship, co-branding, co-marketing and other forms of collaboration.

NMK was established by an Act of Parliament, the Museums and Heritage Act 2006, as a multi-disciplinary institution whose role is to collect, preserve, study, document and present Kenya's past and present cultural and natural heritage. This is for the purposes of enhancing knowledge, appreciation, respect and sustainable utilization of these resources for the benefit of Kenya and the world, for now and posterity.

CityBlue Hotels, Africa's fastest-growing local hotel chain, operates in Kenya (Mombasa, Nairobi and Lamu with new properties opening soon), Uganda, Rwanda, South Sudan, Tanzania and Ghana. CityBlue also has a collaboration arrangement with more than twenty hotels in South Africa and Mozambique.

Professor Mary Gikungu, Director General of the NMK, stated that, “This arrangement is a step for NMK to engage with the private sector with a group that is established, growing, dynamic and cares, like we do, for the welfare of mankind and the conservation of the biological diversity of the East African region and that of the entire planet. The story of NMK and our cultural heritage will be enhanced by this collaboration”.

Jameel Verjee, Founder & CEO of CityBlue Hotels, explained at the Africa Hotel Investment Forum 2024 that “NMK manages many Regional Museums, Sites and Monuments of national and international importance alongside priceless collections of Kenya's living cultural and natural heritage. As an institution that must respond to the growing needs of the society, NMK is striving to contribute in a unique way to the task of national development and we cannot wait to be a partner of NMK on this journey”.
