Current legal framework must transform to respond to society’s current needs – DP Mashatile

Location: News

Current legal framework must transform to respond to society's current needs - DP Mashatile

Deputy President Paul Mashatile says although much has been done to address challenges in the criminal justice system, the current legal framework requires transformation and amendments that align with society in its current form.

He was delivering the keynote address at the official opening of the National Conference on the implementation of the Integrated Criminal Justice System (ICJS) programme and the review of the Criminal Procedure Act.

The conference is expected to be held over the next three days.

“For many years, the integrated criminal justice system and the Criminal Procedure Act of 1977 have had a profound impact on how we handle law enforcement, prosecution, and adjudication in South Africa.

“However, we must examine the current legal framework and identify areas that require transformation or amendment. Our laws must be responsive to the changing needs of society and aligned with international standards,” he said.

Challenges

Mashatile said the criminal justice system “has been put to the test due to widespread corruption, criminality, gender-based violence and femicide” and added that despite government’s concerted efforts, crime remains persistent.

“The prosecution and judicial systems are overburdened; the correctional service is overcrowded, and the police system continues to be besieged as the state fights to prosecute and punish criminal behaviour, frequently compromising on ‘zero-tolerance’ pledges to ‘punish at all costs’.

“Looking at these challenges, it is easy to grow despondent, but we must never be discouraged. Instead, we must double our efforts to reach our desired goal,” he said.

Outlining government’s actions to combat crime and corruption, Mashatile told the conference that tackling lawlessness is government’s top priority.

“We are tackling significant commercial and serious organised crime through the developed Anti-Corruption Task Team (ACTT) and the Directorate for Priority Crime Investigation Operational Committee, currently known as the National Priority Crimes Operational Committee (NPCOC) under the South African Police Service Act.

“Through the Integrated Task Force, we are coordinating the implementation of 205 recommendations for criminal investigations made by the Zondo State Capture Commission. As it stands, three convictions secured and 11 cases are currently before court relating to 36 recommendations. The remaining recommendations are still under investigation,” he said.

Turning to gender-based violence and femicide, Mashatile said the courts are now coming down harder on perpetrators of the scourge.

He said laws that have been passed and Bills at the desk of the National Assembly are enabling the courts to be more efficient and effective in dealing with GBVF.

“In the 2022-2023 fiscal year, the courts have shown a 27.9% increase in life imprisonment sentences for GBVF at Thuthuzela Care Centres, indicating the courts’ robust approach to combating GBVF. Most significantly, the National Assembly approved the Gender-Based Violence and Femicide Bill, which is currently under the National Council of Provinces review.

“The government is responding swiftly to the GBVF epidemic by putting an emphasis on robust institutions and solid evidence. In late 2020, the Department of Justice introduced three amendment bills including the Criminal and Related Matters Amendment Act 12 of 2021, the Criminal Law (Sexual Offences and Related Matters) Amendment Act 13 of 2021, and the Domestic Violence Amendment Act 14 of 2021.

“The latter Act established an electronic repository for domestic violence protection orders, which became operational on April 14, 2023,” he said.

Loss of trust

The Deputy President acknowledged that despite government embarking on crime intervention strategies and other initiatives, “it is concerning the most recent Statistics South Africa Victims of Crime Survey indicates that confidence in our criminal justice system is declining”.

As a result of this, he revealed that the Justice, Crime Prevention and Security (JCPS) cluster is embarking on key interventions to address the challenge of crime.

These include, amongst others:

  • Maintaining targeted efforts to address gender-based violence and femicide and its impact on individuals and communities.
  • Establishing an independent entity called the Investigating Directorate against Corruption within the National Prosecuting Authority (NPA).
  • Enhancing the effectiveness of the Whistle-Blowers Act.
  • Finalising revisions to the Criminal Procedure Act to bolster efforts to combat both crime and corruption.

“As we look towards the future, let us commit to further enhancing and protecting this crucial institution to ensure a just and fair society for all South Africans.

“I am optimistic about the potential outcomes that will emerge from the conference’s discussions, which will ultimately shape the ongoing evolution of the criminal justice system,” Mashatile concluded. – SAnews.gov.za

Investigation into KZN bus crash ferrying ANC supporters

An investigation has been launched into a bus crash which claimed the lives of nine people who were returning home to Mpumalanga after the African National Congress (ANC) election manifesto launch in Durban.

According to media reports, the bus accident happened at around 5am in Paulpietersburg under the eDumbe Local Municipality in Zululand on Sunday.

“The law enforcement team on the scene has so far confirmed nine fatalities. However, they have not concluded the full recovery of the bus at the accident scene.

“Scores of other occupants sustained injuries, with four being more critical [and] they have all been taken to a local hospital. The cause of the accident is being investigated, and experts will be deployed to assist with the forensic investigation,” KwaZulu-Natal Transport MEC, Sipho Hlomuka said.

The MEC said a team was deployed on the scene to work with all law enforcement agencies.

“The investigation has already started, and we are in touch with the bus owner. Our investigation is looking at the condition of the road, condition of the bus, weather during the times of the accident, and the condition of the driver,” Hlomuka said.

He expressed his deepest condolences to the ANC and all affected families and wished those who sustained injuries a speedy recovery.

FIFA (www.FIFA.com) to facilitate inter-confederation friendlies during March match window of even years; Algeria, Azerbaijan, Saudi Arabia and Sri Lanka will host and organise pilot project matches; Initiative aims to provide member associations with key playing opportunities.

In line with the Strategic Objectives for the Global Game: 2023-2027 (https://apo-opa.co/3SW1oEe) and following on from the decision taken by the FIFA Council in December 2022 (https://apo-opa.co/3OTC0hp), FIFA will implement the pilot phase of the FIFA Series during the upcoming Men's International Match Calendar window in March 2024.

The FIFA Series will see world football's governing body support its member associations in organising international friendly matches comprising four national teams from different confederations in a single host country. The initiative will provide member associations with a more regular opportunity to face national teams from other continents, which will serve to unlock technical development opportunities previously unavailable to many of them.

The FIFA Series will also provide the participating member associations with their own additional commercial opportunities and exposure.

Ahead of the full roll-out in March 2026, the pilot project will run from 18 to 26 March 2024. The forthcoming edition of the FIFA Series will feature national teams from all six confederations, and future instalments are planned during every March international match window of even years.

“The FIFA Series is a really positive step forward for national-team football at global level,” said FIFA President Gianni Infantino. “Our member associations have been telling us for a long time now of their desire to test themselves against their counterparts from all around the world, and now they can do so within the current Men's International Match Calendar. More meaningful matches will enable far more valuable footballing interaction for players, teams and fans, and will make a concrete contribution to the development of the game.”

President Ramaphosa pays last respects to Namibian President Hage Geingob

President Cyril Ramaphosa has hailed the late Namibian President Hage Geingob as a leader committed to his people.

Geingob passed away earlier this month while being treated for cancer.

Over the weekend, President Ramaphosa joined the Geingob family and other Heads of State at Geingob’s funeral service held in Namibia.

“I will forever remember, very fondly, his brotherly love. I remain inspired by the dedication he demonstrated towards his work, his undoubted commitment to the wellbeing of his people and his desire to see a peaceful, united and developing continent of Africa.

“His support and guidance to me and to fellow Heads of State and Government within SADC remains invaluable to this day and in the future,” President Ramaphosa said.

According to a statement by the Presidency, President Ramaphosa and Geingob “enjoyed a close relationship”.

“President Ramaphosa reiterates, on behalf of the government and people of South Africa, his deep condolences to the government and people of Namibia, especially First Lady Madame Monica Geingos.

“President Ramaphosa further extends his sympathies to President Nangolo Mbumba, the Cabinet of our neighbouring state and the leadership and members of the SWAPO Party at this time of mourning.

“President Ramaphosa and President Geingob enjoyed a close relationship which infused relations between our two countries. In 2023, President Ramaphosa hosted President Geingob on a State Visit to South Africa in April, while in October, President Ramaphosa undertook a Working Visit to Namibia to co-chair with President Geingob the Third Session of the South Africa-Namibia Bi-National Commission,” the Presidency said.

While in Namibia, President Ramaphosa held a meeting with his counterparts from the Democratic Republic of Congo, Burundi and Malawi.

“The meeting continues from an engagement between the Heads of State that took place in Addis Ababa on the margins of the recently held AU [African Union] Summit. The leaders, whose countries have contributed troops to the SADC Mission in the DRC, discussed efforts towards the restoration of peace and security in the eastern DRC,” the Presidency said. – SAnews.gov.za

Deputy President to Address the launch of Principles and Guidelines for the use of Digital and Social Media in African Elections

His Excellency Deputy President Shipokosa Paulus Mashatile will on Tuesday, 27 February 2024, deliver a keynote address on the launch of principles and guidelines for the use of digital and social media in African elections at the Protea Hotel, Wanderers in Illovo, Johannesburg.

These guidelines seek to create awareness among Election Management Bodies and other stakeholders on the benefits and threats of digital and social media to the electoral process and integrity.

These principles and guidelines are a comprehensive framework for the continental EMBs and were adopted in Cotonou, Benin during the 11th General Assembly meeting of Association of African Electoral Authorities (AAEA) in November 2023.

The Electoral Commission of South Africa provided secretariat support and facilitated the process for the development of these guidelines. The first draft of the guidelines was presented at the validation workshop hosted by the African Union in Addis Ababa, Ethiopia in September last year.

These guidelines are relevant to the South African context as they are aligned to our appreciation of the pivotal role that social media plays in strengthening our democracy, and the importance of social media as a source for credible and factual information to the public.

Infrastructure project funding under the spotlight

Infrastructure project funding under the spotlight

Partnership between the private sector and government, as well as its entities, with regard to the funding of infrastructure projects has taken centre stage at a Southern African Development Community (SADC) panel discussion.

The Government Communication and Information System (GCIS), in partnership with the Department of Water and Sanitation, Infrastructure South Africa (ISA), South African National Roads Agency (SANRAL), and the Industrial Development Corporation (IDC), hosted a virtual discussion focusing on infrastructure.

“The participation of the private sector is key to the delivery of the infrastructure projects, [and] the issue of infrastructure funding is the key if we are to meet the goals set as South Africa and SADC, and the African continent,” Head of Infrastructure South Africa, Mameetsa Masemola, said during the discussion on Friday.

Masemola noted that the National Infrastructural Plan indicates that, just to close the current infrastructure investment gap, South Africa needs something in the region of R5.7 trillion, looking at the priority sectors, including water and sanitation, information and communications technology (ICT), energy, transport, and human settlements.

Masemola said the fiscus alone will not be able to carry and fund these projects, stressing a need to find mechanisms of bringing in the private sector to participate in the delivery of these infrastructure projects.

Highlighting the partnership between SADC and South Africa, the Water and Sanitation Deputy Director-General responsible for Provincial, Entity Governance and International Cooperation, Lindiwe Lusenga, described the collaborations with SADC in supporting the water projects as “excellent”.

Lusenga said partners are willing to put in the funds while also acknowledging the support the department has received from the institutions, including the Global Environmental Funds, and African Development Bank, who have funded feasibility studies for the Lesotho-Botswana Water Transfer Project.

“There is [also] an appetite because of the commitment and the manner in which we intricately commit, and the instruments of governance that we have deployed to enable us to manage these projects, like the Lesotho Highlands Water Project (LHWP). At local level, the industry has come on board, particularly organised business like mining forums that has taken up and assisted the department in local projects,” Lusenga said.

While noting challenges when it comes to funding, SANRAL’s Head of Marketing and Communication, Vusi Mona said the entity has a wonderful working relationship with the region, working through the SANRAL platform.

“We have received a lot of support from the private sector,” Mona said.

Mona also stressed a need to have a matured conversations about how road infrastructure and infrastructure in general is funded.

He also stressed the need to have a serious discussion around the user pay principle, because “we are not going to develop infrastructure without a brazen principle”.

Infrastructure investment

Infrastructure investment is one of South Africa’s critical drivers of economic growth and it also promotes regional integration in the SADC region.

The investment is also a critical driver of future growth of the South African economy, and the provision of superior quality infrastructure allows an economy to be more efficient, improve productivity, and raise long-term growth and living standards.

SADC has made significant progress in regional infrastructure development, including reginal transport and communications systems, which are fundamental to cooperation in the SADC region.

Two to appear in Khayelitsha Court

Two people have been arrested after a 25-year-old kidnapped woman was rescued in the Western Cape.

This followed a collaboration between various specialised units in the South African Police Service (SAPS) in Strand.

On Thursday, a multi-disciplinary Anti-Kidnapping Investigation task team, supported by the Provincial Operations Command Center Combat Unit, detectives, and crime intelligence among others, embarked on a takedown operation.

This followed further investigation into the kidnapping incident of 05 February that is linked to house robbery that occurred in Strand on 26 January.

The investigation led the team to premises situated in Site B off Mew Way in Khayelitsha yesterday, where they search and found two firearms and 200 rounds of different calibres of ammunition.

“Subsequent to the discovery, the members arrested a 29-year-old suspect and seized the firearms, ammunition and two tortoises which were kept in custody without a permit. The members also found small amounts of drugs which were seized,” said the SAPS in a statement on Friday.

The members proceeded to another house where they found the kidnapped woman who was rescued while another 22-year-old female suspect was arrested.

The suspects face charges related to unlawful possession of firearms and ammunition, the possession of presumed stolen property, illegal possession of drugs and keeping of wild animals in captivity without a permit.

The Government Communication and Information System (GCIS) has congratulated Sibusiso Ngalwa who is the current Chairperson of the South African National Editors Forum on his appointment to the Executive Committee of the Africa Editors Forum.

In a statement on Thursday, the GCIS said this appointment is particularly important as the media sector is facing a variety of challenges such as fake news and declining revenues.

The editor’s forum is an expression of the need for editors and all media practitioners on the continent to work together towards preserving journalism and promoting media freedom.

The Africa Editors Forum plays a crucial role in fostering dialogue among media professionals and addressing challenges faced by the media industry across the African continent. The department added that it recognises the significant contributions made by SANEF in upholding press freedom, ethical journalism, and media diversity in South Africa.

Showing up for SA

Location: News

Showing up for SA

Even if one does not usually pay attention on a daily basis to the ins and outs of government and the political landscape in the country; the flurry of activities within this domain  over the past few weeks could hardly be missed.

Invited into our living rooms have been the country’s number one citizen President Cyril Ramaphosa delivering his State of the Nation Address (SoNA) on our TVs; various political parties responding to that Address, and then of course the President again in his reply to those debates.

I should stop here to remind all that we will be seeing all of this again in a few months time, after the National General and Provincial Elections, as in an election year, these Parliamentary proceedings happen twice. Heads up to make plans for those TV snacks in advance!

With all of us entitled to our own views, there have been - as it should be in a robust democracy such as ours - varied responses to the President’s address which sets out deliverables for the year ahead while also setting out government’s key policy objectives. After all, the state of the country does concern each and every one of us.

While the political parties represented in Parliament responded to the SoNA on the national stage, citizens have probably expressed their opinions to each other on the train-ride or minibus taxi to work or at the dinner table.

Others have done so on various social media platforms and in many cases expressing their frustration with the pace of service delivery.

The sixth administration which came to the helm in May 2019, has not had it easy. It is an administration that had to deal not only with the COVID-19 pandemic and its effects on everyday life, but also challenges SA had been facing prior to the arrival of the pandemic - such as poverty and unemployment.

However, in delivering the SoNA, and in reflecting on the last thirty years of our country’s democracy, the President said that perhaps “the greatest damage was caused during the era of state capture.”

This as the effects of state capture continue to be felt across society, “from the shortage of freight locomotives to crumpling public services; from the poor performance of our power stations to failed development projects.”

We must admit that it can’t be easy to turn the fortunes of the country around, especially one that comes from a history of inequality that is still a part of our social fabric today.

I’m not suggesting that we ought to blame the past for all our current challenges. However, as in most cases in life, the past does have a bearing on the present. No  matter how hard one tries, it cannot be ignored.

The past which excluded the majority, reminds government, said the President of the “responsibilities that freedom has placed on our shoulders to forge ahead to realise for all South Africans the promise of a better life”.

While the reference to Tintswalo, the child of democracy is in some quarters being criticised, exacerbated by challenges such as corruption, Tintswalo is no figment of the imagination.

In the eyes of some members of the public, the story of Tintswalo is one of young people unable to find work, unable to complete their studies due to outstanding fees or being held under the thumb of gender-based violence, amongst others.

unquestionably, the reality is that the Ghost of Christmas Past, masquerading itself in the form of poverty and unemployment amongst others, continues to hamper government’s efforts.

However, what remains is that the Tintswalo President Ramaphosa spoke of, is real.

Born in 1994, she grew up in a society governed by a constitution rooted in equality, the rule of law, and affirmation of the inherent dignity of every citizen.

She grew up in a household provided with basic water and electricity, in a house where her parents were likely to have lived without electricity before 1994.

While the Tintswalo of today faces a world different to that of the past, government is committed to bettering the lives of its people.

In the SoNA debate reply, the President noted that despite the contributions made at the debate, “no speaker has been able to refute the fundamental reality that the lives of millions of South Africans have been transformed over the 30 years of freedom.”

Government has and continues to make progress in various aspects of everyday life.

This includes the introduction of the National Minimum Wage, which guarantees the minimum floor below which no worker may be paid, which was introduced for the first time in the country’s history in 2019.

The sixth administration also oversaw the successful raising of the R1.51 trillion worth of investments over the last five-year period through the South Africa Investment Conference (SAIC) that the President announced in 2018.

Held annually over the past five years, the SAIC surpassed the initial R1.2 trillion target to reach the R1.51 trillion in investment pledges.

The transformation of South African lives can be found in the Census 2022 results which among others showed that access to electricity for lighting increased from 58% to 95% between 1996 and 2022 as well as 82.4% of households having access to piped water either inside their dwelling or inside their yard.

Additionally, by November 2023, the 20 specialised South African Police Service Economic Infrastructure Task Teams that were set up to work with business, private security and state-owned enterprises to tackle illegal mining, construction site extortion, cable theft and vandalism of economic infrastructure, had made arrests.

The teams had made over 4 000 arrests for damage of critical infrastructure, 70 arrests for extortion at construction sites and over 3 000 arrests for illegal mining.

With my popcorn in hand, watching the President deliver his address, my bite on this one was clear - the journey of a better South Africa has not been perfect, but succumbing to our challenges is not an option. As South Africans, let’s continue to show up for ourselves and for our country.  -SAnews.gov.za
