Government supports Caster Semenya in legal battle
The Department of Sport, Arts and Culture (DSAC) has expressed that it stands in solidarity, with unwavering commitment, to seek justice for Caster Mokgadi Semenya as she is back in the Grand Chamber of the European Court of Human Rights in France.
The court will reportedly consider whether the double Olympic champion must lower her testosterone levels in order to participate in competitions.
“The department is committed to advocating for fairness and equality in sport. As the country celebrates 30 Years of Democracy, every athlete, regardless of their gender or physical attributes, should have the right to compete without facing unjust obstacles.
"We trust that the Grand Chamber's judgment will uphold these principles and deliver a positive outcome for Caster and all athletes affected by similar challenges,” DSAC Acting Director-General, Dr Cynthia Khumalo, said on Wednesday.
Government is working in collaboration with the Commission for Gender Equality (CGE), Norton Rose Fulbright (NRF), Probono.org, and various other stakeholders to support Semenya on the matter.
“The DSAC notes the hearing scheduled for Wednesday, 15 May 2024, where the Grand Chamber will evaluate the matter presented by the Swiss government in relation to the European Court of Human Rights’ July 2023 decision. Caster Semenya has endured years of unfair discrimination based on her gender.
“The 2019 regulations imposed by the World Athletics body created significant challenges for athletes with Differences in Sex Development (DSD), who wish to compete in their chosen sport. This ruling reaffirmed the international legal requirement for World Athletics to refrain from engaging in discriminatory practices, barring exceptional circumstances,” the DSAC said.
The CGE has called on all to rally behind Semenya’s endeavour to seek justice not only for herself, but for other affected athletes.
“A finding by the Grand Chamber that issues between international athletics bodies, such as World Athletics and individual athletes, are not a matter of private law but of public human rights law are transformative and progressive.
"A favourable outcome will be of massive importance to athletes with differences in sexual development worldwide,” Chairperson of the CGE, Advocate Nthabiseng Sepanya-Mogale said.

DSAC said the referral to the Grand Chamber is in accordance with the violations identified by the Court in Switzerland vs Caster Mokgadi Semenya.
“These violations encompassed a breach of the prohibition on discrimination, a denial of the right to an effective remedy, and a failure to respect private life.
“Government, through the department, has consistently advocated and supported initiatives aimed at resolving this matter equitably. The DSAC remains optimistic that the Grand Chamber's decision will reflect the values of justice, inclusivity and diversity that underpin the South African sporting sector,” DSAC said. – SAnews.gov.za

Former athletics boss pays back the money
Former Athletics South Africa Acting CEO, Terrence Magogodela, has paid back ill-gotten gains he unduly gained from the National Lotteries Commission (NLC) grant funding for a sports facility development.
According to the Special Investigating Unit (SIU), Magogodela agreed to pay back some R388 733,05 after it was found that he signed a funding application to construct athletics tracks in the Northern Cape but used the money to buy property.
“On the form, he indicated that he was the project coordinator for Inqaba Yokulinda, but he was neither the project coordinator nor a member of [non-profit organisation] Inqaba Yokulinda.
“The funding application, the business and implementation plan, and an endorsement letter from ASA [Athletics South Africa]were submitted to the NLC. Magogodela channelled the NLC funds towards a property in Gauteng,” the SIU said.
Following investigations, Magogodela relented to paying back the money.
The SIU also warned that the payment does not shield the former athletics boss from criminal prosecution.
“Initially, a settlement agreement was reached but Magogodela failed to honour it. This prompted the SIU to approach the Special Tribunal for an application to preserve his Gauteng home. In February 2022, the Special Tribunal granted the SIU a preservation order for Magogodela’s property.
“Following the full payment made by Magogodela, the SIU will approach the Special Tribunal for an application to discharge his property from the preservation order. However, the settlement agreement does not constitute a full and final settlement between the parties. SIU remains entitled to join Magogodela in any future proceeding and claim appropriate relief from him.
“The settlement with Magogodela is part of the implementation of the SIU investigation outcomes and consequence management to recover financial losses suffered by State institutions due to negligence or corruption. The settlement agreement does not absolve Magogodela from possible prosecution,” the SIU said. – SAnews.gov.za

The Western Cape's primary school athletes won the national track and field championships in Limpopo for the first time ever since the inception of the competition.
The athletes competed on 25 and 26 March 2024 at the Oscar Mpetha Stadium at the University of Limpopo in Polokwane.
The team took home 32 gold medals, 20 silver medals and 18 bronze medals and, of course, the Championships Trophy!
Provincial Education Minister David Maynier wished the team well ahead of their departure last weekend and is delighted by their success.

Social Development to keep older persons fit and active in Mbombela
As the country commemorates Human Rights Day, the Department of Social Development will use the day to promote the rights of older persons through dialogue and sporting activities in Mbombela, Mpumalanga.
The active ageing programme will be held on Thursday in collaboration with the South African Older Persons Forum (SAOPF), under the theme: “Leaving No One Behind during the Decade of Healthy Ageing”.
The programme seeks to improve the quality of life, health, and well-being of older persons by instilling dignity, peer social integration, as well as promotion of senior citizens’ voices and the creation of awareness concerning their ability to express themselves through dialogue, music, sport, and recreational activities.
The active ageing programme will unfold through an interactive dialogue where older persons will have the opportunity to participate in a democratic manner by independently expressing themselves on how they would like to be treated by authorities and society.
Among other topics, they will reflect on the role of traditional leadership in the promotion and protection of the rights of older persons, family care and support.
Older persons will also participate in various sporting activities including soccer and athletics which are an essential component of active ageing programme.
All government departments, tasked with the implementation of the Older Persons Act will be part of the proceedings
“In choosing to concentrate on the human rights of older persons, the department is trying to encourage the country to respect the human rights of older persons as enshrined in the Constitution.
“The active ageing programme is a platform to inform older persons about their rights; establish cooperation with government so that older persons’ rights, concerns, needs are identified, voiced, and addressed,” the department said in a statement.
According to the 2022 Census report, the country’s older persons population was estimated at 5.6 million. The report shows an increase in the number of older persons across all provinces, with highest number of the older population being in Gauteng at 1.4 million and KwaZulu-Natal at 940 000.
“This is an indication that South Africa is becoming an ageing society which is not immune from the burden of disease that can cause disability due to an increase in old age-related chronic diseases.
“In a few decades, the loss of health and life worldwide will be greater from non-communicable or chronic diseases, such as, cardiovascular disease, dementia and Alzheimer’s disease, cancer, arthritis and diabetes among others,” the department said.
The department highlighted that in South Africa older persons are faced with numerous challenges including, gender-based violence and femicide. They are often deprived from enjoying their old age as they are often forced to take care of orphaned and vulnerable grandchildren. - SAnews.gov.za
