President seeks better prospects for matric Class of 2024

President Cyril Ramaphosa has in his weekly newsletter, extended his best wishes to learners writing their matric exams, acknowledging the hard work, resilience and perseverance they have shown in preparing for this crucial milestone.

Today marks the commencement of the 2024 National Senior Certificate (NSC) exams, with over 880 000 candidates across South Africa sitting for their matric exams. 

“On behalf of the government, I wish all our learners well at this challenging and exciting time. The Class of 2024 entered Grade 8 at the height of the COVID-19 pandemic and have had to receive considerable learning support to overcome the resultant gaps in their learning,” the President said on Monday.

The first citizen praised the students who are rewriting their exams through the Department of Basic Education (DBE) Second Chance Programme, commending their determination to improve their academic outcomes. 

In the weeks leading up to the exams, learners across the country have participated in extra lessons, engaged in revision with educators, and attended learner support programmes facilitated by provincial education departments. 

The President highlighted the collaboration between the DBE, provincial education authorities, school governing bodies, and families in equipping learners with the resources needed for success.

“I commend our nation’s educators for their commitment to our matriculants as they reach the end of their secondary school journey. 
“At the annual National Teaching Awards ceremony earlier this month, I spoke of teachers as being like devoted gardeners, whose attention, guidance and encouragement nurtures our nation. The successes that the Class of 2024 will undoubtedly achieve will be in no small part due to the efforts of our country’s devoted teachers,” the President said.

As the exams commence, all necessary systems have been put in place to ensure a smooth examination period. 

The Department of Basic Education, in collaboration with Umalusi, has conducted audits of over 9 200 exam centres, vetted exam markers, and approved question papers, including those adapted for learners with special needs. 

Additionally, stringent measures have been implemented to prevent question paper leaks, fraud, and cheating, including the appointment of additional invigilators and enhanced security measures, such as the use of CCTV at some venues.

President Ramaphosa expressed gratitude to the matric candidates for signing the NSC Examination Code of Conduct, which commits them to maintaining academic honesty during the exams.

According to the DBE, by signing the Matric Exam Pledge, learners publicly commit to upholding ethical standards during the exams and remaining focused on their goals.

Integrating young people into the workforce

The President used the occasion to reflect on the importance of integrating the Class of 2024 into the workforce or further education after their exams. 

“The unemployment rate among young people aged 15-24 stands at 60.8%, according to the latest Quarterly Labour Force Survey. 

“Just as preparing our nation’s young people to achieve success in this exam is a collaborative effort, there is much more that partners like the private sector can do to hire young people.”

To address this, the President has called on employers to relax work experience requirements for entry-level positions and make use of incentives, such as learnership agreements, discretionary grants, and the Employee Tax Incentive, to hire young people.

The incentive is aimed at encouraging employers to hire young and less experienced work seekers.

The President also emphasised the legal obligation of employers to prioritise hiring South African citizens or permanent residents before considering foreign nationals for positions, underscoring the need to provide more opportunities for young South Africans.

“Recent business premises inspections by the Department of Home Affairs and the Department of Employment and Labour have thrown into sharp relief the contentious issue of some employers preferring to employ foreign nationals and illegal immigrants. 

“Employers must instead open up more opportunities for young South Africans entering the job market. They need to remember that by law they have to ensure that no suitable South African citizen or permanent resident is available to fill a position before employing a foreign national. This is established practice around the world,” the President said.

The President concluded by urging all sectors of society to work together to ensure that the hard work of the Class of 2024 is rewarded with employment, further education, and training opportunities. 

He reaffirmed his commitment to supporting the youth in their journey toward a brighter future.

“As all of society, we have a responsibility to ensure that the morale of the Class of 2024 is boosted by knowing their hard work and sacrifices will be rewarded. Let us continue to work together to ensure that the latest cohort of matriculants find the opportunities for employment or further education and training that they deserve,” he said. – SAnews.gov.za

Former MP and seven others arrested for alleged tender corruption

Seven people – including a former Member of Parliament – have been arrested for alleged corruption related to a R27 million tender.

The seven were arrested by the Hawks’ Serious Commercial Crime Investigation unit in Gauteng on Wednesday morning.

Hawks spokesperson Brigadier Thandi Mbambo said the arrests were related to the awarding of a 2016 tender at the Gauteng Department of Agriculture and Rural Development (GDARD).

“Their arrest follows a forensic report by the Special Investigating Unit [SIU], which discovered that in October 2016, the [GDARD] issued a tender requesting proposals to integrate and formalise waste operatives... into the mainstream waste management economy. A tender of around R27 million was then awarded to Enviro-Mobi in March 2017. 

“The contract agreement between the department and Enviro-Mobi stipulated that the department may consider to pay, on condition that 50% of the work has been completed and no upfront payments may be made to the service provider.

“During investigation, it was established that the Chief Director and Chief Financial Officer processed and paid over R25 million to Enviro-Mobi for 200 motorised three wheelers, though all goods were still in the possession of the service provider,” Mbambo said.

The suspects are expected to face charges of fraud, theft, and contravention of the Public Finance Management Act and Prevention of Organised Crime Act. – SAnews.gov.za

Special Investigating Unit: cracking down on corruption

The Special Investigating Unit (SIU) has closed more than 1900 cases during the 2023/24 financial year.

The unit also handed over 26 comprehensive reports to President Cyril Ramaphosa on the outcomes of investigations.

“These reports include, amongst others, the investigations about the National Lotteries Commission, Passenger Rail Agency of South Africa (PRASA), the Masters' Office, and National Student Financial Aid Scheme (NSFAS). These reports reflect the SIU’s dedication to transparency and accountability in the fight against corruption.

“The SIU has referred evidence for the institution or defence/opposition of civil proceedings worth R4.8 billion. This includes, amongst others, matters regarding R2 billion from Eskom, R834 million from Transnet, R29.1 million from the eThekwini Metropolitan Municipality and R48.4 million from the City of Cape Town,” the unit said in a statement.

The unit has conducted lifestyle audits at PRASA, the Gauteng Office of the Premier, and the Free State Department of Community Safety, Roads, and Transport.

The SIU said it was committed to partnering with other law enforcement agencies to combat corruption.

“The SIU recognises the importance of collaboration in the fight against corruption. In line with the SIU Act, 583 criminal referrals were made to the National Prosecuting Authority, ensuring accountability prosecution of officials, private entities and individuals involved in corrupt activities. 

“These referrals reflect the unit’s ongoing efforts to ensure consequences for those who engage in corruption, maladministration and fraud. To ensure accountability for government officials involved in wrongdoing, SIU referred 297 officials to respective state institutions for disciplinary action,” the statement read.

The corruption busting unit is now within the fifth year of its turnaround strategy and has vowed to keep up the fight against criminality.

“[We] remain resolute in our mission to combat corruption, fraud, maladministration and malpractice in the public sector.

“The next five-year strategy will build on the successes of the previous strategy and focus on developing and implementing the National Corruption Prevention Strategy and implementing best practices, including cyber and data analytics, and further business process digitisation programmes,” the statement said. – SAnews.gov.za

Ex-Eskom official convicted of fraud and corruption

Former Eskom Safety Risk Officer Thandi Ruth Magagula has been convicted of fraud and corruption in relation to the fraudulent awarding of contracts at the power utility.

According to the National Prosecuting Authority, Magagula pleaded guilty to seven counts of corruption and two of fraud.

She was subsequently convicted in the Middelburg Specialised Commercial Crimes Court under Section 17(1) of the Prevention and Combating of Corrupt Activities Act 12 of 2004.

“The offences stem from contracts valued at over R58 000 awarded to a company named Mantoza Engineering Projects CC during the period between April 2015, while Eskom employed Magagula and simultaneously served as a director of Mantoza Engineering Projects. 

“Magagula failed to disclose her financial interest in the company to Eskom's management and continued to conduct business with the public entity while holding a directorship position,” the NPA said in a statement on Monday.

The matter has been postponed to 24 October for sentencing. 

“This behaviour violated laws governing public officials and Eskom's conflict of interest policies During plea proceedings, Magagula was convicted in line with her admissions of guilt confirming her role in the corrupt activities.

“The NPA views this conviction as a significant step in the fight against corruption, particularly within critical public entities like Eskom. The NPA remains committed to holding individuals accountable for corrupt practices, reinforcing public service integrity,” the prosecutorial body concluded.

Last week Cabinet welcomed the arrest of six engineering firm directors accused of Black Economic Empowerment fronting and tender fraud of R400 million at Eskom and Sasol.

Hawks crack down on criminals

The Directorate for Priority Crime Investigation (DPCI), also known as the Hawks, will continue to pursue criminals without fear, favour or prejudice.

This is according to Hawks Head, Lieutenant General Godfrey Lebeya, who briefed the media on Sunday to outline progress and take stock of milestones achieved during the second quarter of the 2024/25 financial year.

“The DPCI remains committed to its mandate of investigating, preventing, and combating national priority offences without fear, favour or prejudice. The DPCI has made significant inroads in apprehending individuals involved in high-profile cases, thus ensuring accountability and justice for the victims. 

“These arrests targeted people involved in serious corruption, serious organised crime, serious commercial crime, including fraud, theft, money laundering, police killings, cash-in-transit robberies, illegal mining, drug trafficking, damage to essential infrastructure and trafficking in endangered species,” he said.

During the reporting period, some 818 natural and juristic persons were arrested and appeared in courts around the country.

Most of the suspects were arrested in Gauteng, the North West and KwaZulu-Natal.

During these arrests, some 84 firearms and 2 049 rounds of ammunition were seized. Seven clandestine drug laboratories were dismantled, with a total value exceeding R17 million.

“During this same period, the Directorate secured convictions on 301 accused. Of these convictions, 285 accused persons, inclusive of 13 juristic persons, were sentenced, while the balance of 16 convicts are to be sentenced on dates after the quarter under review.

“Of the 272 sentenced natural persons, 164 are South Africans, while 108 are foreign nationals. Most of these convictions and sentences were secured in the Gauteng province.

"Of these convictions, the Serious Organised Crime Investigation unit secured 143, Serious Commercial Crime Investigation secured 120 and Serious Corruption Investigation secured 22. We shall, in the coming months, analyse the 16 convicts, as and when they are sentenced,” Lebeya said.

Furthermore, the Priority Crime Specialised Investigation has “contributed towards the issuing of a combined 75 freezing and forfeiture orders”, amounting to more than R72 million.

“An amount of R8 178 798.87 has been deposited into the Criminal Assets Recovery Account. These [bring] the total recorded successes on arrests, convictions and attachment of assets to 1 194.

“[In] line with our moto of 'Seek, find and strike', the DPCI shall continue to execute its mandate without fear, favour or prejudice, in accordance with the Constitution and other laws of the Republic,” Lebeya said. – SAnews.gov.za

Police killings an 'assault on society and attack on the State' - Hawks Head Lebeya

Seventeen police officers have been killed in the second quarter of the 2024/25 financial year.

This is according to Directorate for Priority Crime Investigation (DPCI) Head, Lieutenant General Godfrey Lebeya, who briefed the media on Sunday.

At least 13 of the officers were off duty at the time of the incidents, while four were on duty when they were killed.

The Lieutenant General condemned police killings, which the DPCI categorised as a national priority offence that “requires the attention of the DPCI”.

“There exists a blue wall in South Africa. A human wall formed by men and women in blue. The wall that divides and shield the good from the bad elements in society. The stronger the wall, the safer the community. 

“The weaker the wall, the happier the criminals. Criminals will continuously attack this wall in order to access the protected good citizens of this beloved country. An attack of police officials is an assault on society and indeed an attack on the State,” he said.

He cited four examples of arrests and convictions secured following the killing of an officer, including that of a man who masterminded the killing of his own wife, who was seven months pregnant at the time.

“On 23 June 2022, Constable Prudence Masuku, who was stationed at Daveyton SAPS [South African Police Service] was murdered in Putfontein while on her way to work [and was] accompanied by her husband, James Veli Masuku. 

“The husband alleged that they were confronted by two taxis, where the passengers of both taxis approached them and began firing several shots at the deceased, while he ran for cover. He said that upon returning to the vehicle, he found that his wife’s service pistol had gone missing. 

“Investigations by the Hawks’ Serious Organised Crime Investigation and ballistic results revealed that the service pistol belonging to the deceased was in fact the very weapon that was used to murder the member,” Lebeya said.

During investigations, law enforcement officials Veli Masuku and Xolani Lawrence Dlamini after swiftly reacting to information about a suspect demanding cash from a middleman for murdering the police officer.

“On 08 April 2024, Masuku and Dlamini – who pleaded not guilty – were convicted of murder, theft of firearm, two counts of illegal possession of firearm and defeating the administration of justice.

“On 23 August 2024, the Gauteng High Court sitting in Benoni sentenced Masuku and Dlamini to life imprisonment for murder. They were further sentenced to five years imprisonment for the theft of a firearm, five years imprisonment for possession of unlicensed firearm, and three years imprisonment for illegal possession of ammunition, which runs concurrently with the life imprisonment sentence. They were further declared unfit to possess firearms in the future,” Lebeya said.

Unscrupulous legal practitioners

Lebeya told the media about legal practitioners, who are stealing money from unsuspecting clients’ trust funds, Road Accident Fund payouts and deceased estates.

Some of the cases Lebeya cited include:

  • An attorney, Solomon Slom, arrested for allegedly stealing R39 million from a client’s trust fund.
  • An attorney, Thouret Mampe Thabe Tiro, appeared in court for allegedly defrauding the Ditsobotla Local Municipality of R460 000 by submitting false request for payment.
  • Attorney, Kobie Nieuwenhuis, allegedly misappropriated at least R243 000 after the Master of the High Court appointed her as the executor of an estate.
  • Three attorneys – Mkhululi Enock Tokota, Masixole Bangiso and Michael Songezo Tuswa –  appearing in different, unrelated cases related to fraud and theft of Road Accident Fund payouts.

“Legal practitioners are officers of the court. Theirs is a profession of honour. It is important that our learned colleagues should continue to maintain the decorum of this great profession. They must be exemplary to upcoming jurists and jealously insulate the image of this profession. 

“Those who betray that trust need to take full responsibility and the Legal Profession Council should continue to police those who breach professional ethics. It should ensure that all legal practitioners observe a settled expectation of uberrima fides, the highest possible degree of good faith in dealing with client during submissions, representations to client so that they are accurate, honest and frank. 

“It is comforting that prosecutors, the defence and the presiding officers who deal with these matters are jurists in good standing,” Lebeya said. – SAnews.gov.za

Police Minister Senzo Mchunu has commended the outstanding work of the South Police Service (SAPS) following the successful arrest of a 43-year-old Sergeant, after an extensive two-month investigation led by Captain Keshi Mabunda.

Mabunda is renowned for his exceptional work in dismantling insurance fraud syndicates. 

The Sergeant in question has been linked to the brutal and senseless murder of six individuals in and around Polokwane, Limpopo.

The victims, who lost their lives under tragic and horrifying circumstances, were part of a calculated and heinous scheme to defraud life and funeral insurance policies amounting to R10 million.

“I want to take this moment to commend Captain Mabunda and his team for their tireless and meticulous work in bringing this rogue officer to justice. Their dedication to the rule of law and the protection of our citizens is an embodiment of the integrity we expect from the SAPS,” said Mchunu, commending the SAPS on their sterling work.

“The nature of these crimes is deeply disturbing, with the victims meeting their ends in various violent ways. Such cruelty and disregard for human life is utterly reprehensible and it is all the more shocking when perpetrated by someone sworn to uphold the law and protect the innocent.

“At the same time, I must strongly condemn, in the clearest possible terms, any acts of corruption, criminality, or betrayal by members of the police service. This arrest serves as a stark reminder that there is no place in the SAPS for officers who abuse their position of authority for personal gain or engage in unlawful conduct. 

“Such actions not only harm innocent lives but also erode the trust that the public places in law enforcement. Let me be unequivocal: we will root out corruption and criminality from within the ranks of SAPS. Any police officer found to be involved in crime will be prosecuted to the full extent of the law.

President Cyril Ramaphosa offers his deep condolences to the family and former colleagues of former Judge Willem Heath who passed away at the age of 79.

Judge Heath, a graduate of the University of Pretoria, served as a prosecutor in the early years of his career before practising as an advocate and later becoming a Judge of the High Court.

From 1995 to 1997, he chaired a Commission of Inquiry into corruption, fraud and maladministration in the Eastern Cape.

One of the outcomes of the Commission was the establishment by President Nelson Mandela of the Special Investigating Unit as an independent agency of government that investigates corruption and maladministration in state institutions.

President Mandela appointed Judge Heath, who had played an instrumental role in dradting the Special Investigating Unit and Special Tribunals Act, as the first head of the unit.

President Ramaphosa said: “Judge Willem Heath will be remembered as an early architect of government's anti-corruption architecture and a pioneer in the efforts, early in the life of our democracy, to rid the state and society of corruption and maladaministration.

“May his soul rest in peace.”

Head of the Special Investigating Unit (SIU), Advocate Andy Mothibi, has expressed condolences to the family and friends of former Judge Willem Heath, following his death this week.

Heath served as the first head of the corruption busting unit. The SIU's foundation can be traced back to 1995 when former Judge Heath led the Heath Commission of Inquiry. The commission’s groundbreaking work revealed a critical gap in law enforcement, highlighting the need for a permanent body to address fraud, corruption, and maladministration - a role the SIU continues to fulfil today.

Under Heath’s leadership, the Heath Commission investigated incidents of fraud, corruption, and maladministration in the Eastern Cape, earning widespread recognition for its achievements. His leadership helped establish a strong stance against corruption and introduced proactive measures to safeguard State resources, solidifying the SIU's role as a guardian of the public purse.

Heath began his career as a prosecutor before establishing a successful private practice, where he made significant contributions to the legal field. Appointed by former President Nelson Mandela in 1995, he played a pivotal role in establishing the Special Investigating Unit (SIU), one of the country’s foremost corruption-fighting agencies. 

Under his stewardship, the SIU undertook critical investigations that set new benchmarks for public sector accountability, ensuring that justice and integrity prevailed.

“Former Judge Heath’s unwavering dedication to eradicating corruption and upholding the rule of law has left an indelible mark on our nation’s judiciary and public life. 

“As the SIU, we will carry forward Judge Heath’s legacy and values and pledge to uphold the principles of fairness and accountability that the late judge championed throughout his career. His wisdom, fairness, and steadfast commitment to justice will be deeply missed by the members of the SIU, the legal fraternity, and the entire country,” Mothibi said.

The unit paid homage to Heath as a “pivotal figure in the fight against corruption” and for laying the foundation for the formation of the SIU.

“Former Judge Heath, often referred to as ‘the people’s judge’, was approached by former President Nelson Mandela and the then-Minister of Justice, Dullah Omar, to assist the Department of Justice and the Office of the State Law Advisor in drafting the Special Investigating Units and Special Tribunals Act. He subsequently became the inaugural head of the SIU.

“Under former Judge Heath’s leadership, the Heath Commission investigated incidents of fraud, corruption, and maladministration in the Eastern Cape, earning widespread recognition for its achievements. 

“His leadership helped establish a strong stance against corruption and introduced proactive measures to safeguard state resources, solidifying the SIU's role as a guardian of the public purse,” the SIU said. – SAnews.gov.za
