TNPA invites service providers for Liquefied Natural Gas at Ngqura

The Transnet National Ports Authority (TNPA), in collaboration with Infrastructure South Africa (ISA) and the Industrial Development Corporation (IDC), has approached the market for an Environmental Impact Assessment (EIA).

This is to encourage interested parties to submit proposals for the envisaged Liquefied Natural Gas (LNG) terminal at the Port of Ngqura.

The Request For Proposals (RFP) process will see the appointment of a service provider contracted to assess the environmental compliance and sustainability of the proposed LNG terminal. 

This involves conducting a detailed analysis of ecological and local regulations to determine critical environmental authorisations. These include a seismic survey, marine ecology, climate change impact assessment and socio-economic assessment to support the project.

The EIA process is carried out in tandem with negotiations of the Terminal Operator Agreement (TOA) between TNPA and the Strategic Fuel Fund (SFF) to build and operate an onshore LNG regasification facility at the Port of Ngqura for 30 years. 

The appointment of SFF is the outcome of a Section 79 process and directive issued by the former Minister of Transport, in accordance with the National Ports Act of 2005.

“This milestone is a critical step towards the development of the LNG terminal at the Port of Ngqura. Through its commercial seaports, TNPA is at the forefront of enabling the gas-to-power project pipeline whilst ensuring the security of supply and unlocking global opportunities for sustainable impact,” said Acting TNPA Chief Executive, Phyllis Difeto.

The Port of Ngqura LNG Terminal is one of 12 priority infrastructure projects announced in March 2024 that hold a Strategic Integrated Project (SIP) status. 

The triad strategic partnership is fast-tracking the conclusion of the EAI, with the RFP closing on 30 October 2024. This partnership will also see the issuing of the RFP for Prefeasibility Studies by end September 2024.

“ISA is established to provide strategic, technical and financial advisory support to project sponsors for the planning, preparation, development and implementation of national pipeline projects and strategic integrated projects,” said Mameetse Masemola, the Acting Head of Infrastructure South Africa.

UIF announces extended operating hours

The Unemployment Insurance Fund (UIF) has announced that selected service points will be open on Saturdays to render services to clients and employers during the month of September.

“A decision to extend operating hours at UIF service points and to ramp up capacity was taken in anticipation of increased demand for real-time services, after the Pretoria High Court at the end of August 2024 issued an interim interdict preventing a service provider from implementing a new contract for support and maintenance services to the uFiling platform,” the Department of Employment and Labour said in a statement. 

uFiling is an online platform used by clients and employers to apply for UIF benefits or to register companies with the UIF, declare employees and pay over contributions to the Fund.

The platform is not connected to the main UIF system used to adjudicate and process claims. 

“Due to the uFiling platform not having any support or maintenance at this time, its services was suspended. The Unemployment Insurance Fund (UIF) has since the suspension of uFiling processed more than 181 000 claims at service points around the country, totalling a pay out of R419 607 185,” the department said. 

Extended operating hours will be rendered from 07:30 until 16:00 at UIF service points within labour centres during September month as follows:
•    In Gqeberha, East London and Qonce in the Eastern Cape province.
•    At the Pietermaritzburg and Richards Bay labour centres in KwaZulu-Natal.
•    At the Emalahleni, Secunda, Middleburg, Malelane and Mbombela labour centres in Mpumalanga province.
•    At Mahikeng, Potchefstroom, Lichtenburg, Klerksdorp, Vryburg, Christiana, Brits, Taung and Rustenburg labour centre in the North West province.
•    Cape Town, Paarl, Mitchells Plain and Bellville in the Western Cape.

Registration of employers

New employer registrations can be done through BizPortal, available on https://www.bizportal.gov.za/services.aspx.

The department has urged its clients to note that BizPortal is only for employer registration and will not be able to register employees. Employee registration can be undertaken at a nearby labour centre.

Registration can also be done by downloading UI.8 and UI.19 forms from www.labour.gov.za and submitting the completed forms to e-mail address newui8registrations@labour.gov.za.

Declaration of employees

Employers with electronic payroll systems may declare their employees by sending live payroll files to e-mail address Declarations@labour.gov.za or by visiting a nearby labour centre for services. 

In case of a manual declarations an employer can download a UI.19 form from www.labour.gov.za and submit a completed form via email to uif.declarations@labour.gov.za.

Regarding contributions, the department said an employer pays contributions to the UIF before the 7th day of each month. Where the 7th day is not a “business day” such as a Saturday, Sunday or public holiday, payments must be made on or before the last business day. 

“UIF contributions are made up of 2% of an employee’s salary. 1% is deducted from the salary of an employee and 1% contributed by the employer.

“Employers who are registered for tax purposes and/or the Skills Development Levy (SDL), must pay their contributions directly to the South African Revenue Services (SARS),” the department said. 

Employers can also pay contributions using bank details provided on the Department of Employment and Labour website www.labour.gov.za and use their UIF reference number as the reference for payment. 

“Through queue management, monitoring of operations and staff repurposing the UIF has been able to adequately handle claim volumes around the country. The Fund is confident that by extending working hours it will be able to maintain the status quo whilst developing alternative online solutions for clients and employers,” the department said. – SAnews.gov.za

The Portfolio Committee on Justice and Constitutional Development today held a lengthy, thorough and frank engagement with the Justice and Constitutional Development Minister, Ms Thembi Simelane, on the allegations relating to a VBS Mutual Bank loan.

Committee Chairperson Mr Xola Nqola said members of the committee take their responsibility of holding the executive to account extremely seriously. “You could see from the engagement that members are robust, aggressive in line of questions, prepared and wanted answers. At the same time, the Minister was eloquent and did not shy away from responding to those robust questions.”

Mr Nqola said the Minister took the committee into her confidence about the loan and reiterated that it was not a kickback but rather a loan that she fully repaid. “This was a crucial matter and the committee, the country, needed clarity on it,” he said.

The Minister informed the committee that she wanted to purchase a coffee shop and intended to withdraw from her retirement savings to do so. However, when she understood the tax implications of this course of action, she realised it did not make financial sense to do so. She then approached Gundo Wealth Solutions, which indicated that it could provide a loan for the purchase. The minister explained that although she was mayor of the Polokwane Municipality at the time of the loan, Gundo Wealth Solutions was not one of the municipality's service providers.

The committee heard that the Minister was unaware that Gundo was not a registered financial service provider. She emphasised that she took a loan from Gundo and not VBS Mutual Bank.

The Minister assured the committee that she did not have an improper relationship with Mr Ralliom Razwinane, the owner of Gundo Wealth Solutions, who has since been arrested on corruption charges relating to VBS Mutual Bank. The Minister went on to say that she did not receive any improper benefits from the loan contractor.

The Minister does not own the coffee shop anymore and told the committee that she closed it when the lease was up for renewal during the Covid-19 pandemic.

The committee also questioned her about perceptions of a conflict of interest in relation to her influence over the National Prosecuting Authority to prosecute those accused of VBS-related corruption, which has the potential to undermine public confidence in the justice system. The Minister assured committee members that she will make sure that the conflict of interest does not arise. She pointed out that the Minister does not decide who to prosecute and not to prosecute.

Mr Nqola said the committee has a responsibility to conduct “aggressive oversight” over VBS prosecutions. He highlighted that it is not illegal to enter into a loan contract with a juristic person, even if they are not a registered loan provider.

In closing, he said the committee will obtain a legal opinion from the Parliament Legal Services on whether the committee can have access to the loan agreement between the Minister and Gundo Wealth Solutions.

Justice Minister appears before Parliamentary Committee on VBS allegations

Minister of Justice and Constitutional Development, Thembi Simelane, says she did not have any improper relationship with a contractor appointed by the Polokwane Municipality.

Last week, allegations surfaced in the media that Simelane, while she was Mayor of Polokwane Municipality in Limpopo, received at least R575 000 in a loan from a company intimately linked to VBS bank.

“I did not have any improper relationship with the contractor appointed by the municipality. Mayors are never involved…in procurement. The work of appointment of a service provider is the responsibility of the executives in the municipality.

“[Gundo Wealth] were appointed to provide services through a procurement process and this was done through committees of council. I did not receive any improper benefits from the contractor,” she said.

The Minister appeared before Parliament’s Portfolio Committee on Justice and Constitutional Development to present clarity on allegations of impropriety on her part related to VBS Mutual Bank.

On the issue of whether or not there is a conflict of interest in her position as Minister and the National Prosecuting Authority (NPA) – which is prosecuting the VBS Mutual Bank saga – the Minister said the department plays no role in the decision-making of the NPA on who to prosecute or not. 

“The office I hold does not have a direct relationship in instructing or convincing the NPA on how to act on their mandate.

“On the matter of taking the loan, I have dealt with the conflict of taking the loan. My understanding is that, if you ask for assistance on someone who doesn’t have a direct bearing or payment with the municipality, it is possible and I repaid it,” she said.

Simelane explained that the loan was for a business that would create wealth for herself and family after she leaves public office.

“Political positions by their very nature are short term and necessitated me to investigate a feasibility [study] of commencing such a business and a coffee shop seemed a feasible option so that I could create an employment opportunity for myself and my next of kin.

“I made this consideration…to ensure that I have an alternative when the public office life comes to an end,” she said. 

The Minister said she had initially intended to partially withdraw from her retirement savings to fund the coffee shop but the “percentage of tax made the idea not feasible”.

“I asked Gundo for advice on any other idea on how best I could get finance and I was advised against the withdrawal of the retirement savings. In those discussions, Gundo then informed me and advised of a loan product that they have that I could access.

“In consideration for the options…there existed no conflict in my view is securing a loan from Gundo. I took a decision to proceed with the business,” Simelane said.

She added that the loan was repaid over three instalments.

Treasury steps in

Simelane told the committee that as the beginning of the decline of VBS Mutual Bank began to set in, National Treasury told municipalities that it was a breach of regulations to invest in mutual banks.

The Minister said she had already taken steps to ensure that the municipality withdraws from VBS, even before the directive from Treasury.

“[On] the advice of technical experts within the municipality, myself as the mayor, instituted the withdrawal of Polokwane Municipality from VBS. My attitude at the time was, if there was anything improper with regard to municipality funds, it must be stopped,” she said.

A Treasury-led investigation into municipal investments at the bank began after that – a process the Minister insists she “fully participated” in. This was followed by a report.

“That report didn’t spare me as the Executive Mayor from corrective measures. The…sanction to us was to either go to University of Pretoria or University of Witwatersrand which are the only ones that offers…a programme which is designed by National Treasury which is called Municipal Management [Programme].

“I took this corrective measure very seriously [and] commenced with my studies the following year when universities opened. I concluded this programme…after I was no longer a mayor, when I was a Deputy Minister,” she said.

Turning back to the matter between the municipality, her loan and VBS Mutual Bank, Simelane re-emphasised that she received no improper benefits.

“[I] affirm that one: there was no improper relationship. I requested for a loan, a loan was advanced.” –SAnews.gov.za

Transport department announces preferred bidder to print new driving licence card

The Department of Transport has announced the appointment of IDEMIA Identity and Security - South Africa as the preferred bidder to produce new smart driving licence cards. 

The appointment was approved on 8 August 2024.

IDEMIA is expected to enter into a service level agreement with the department before commencing with its work to put in place the infrastructure and systems. 

More information in terms of the timeframes will then be made available to the public once the service agreement has been signed.

“The new licence card will incorporate new security features aimed at eliminating the ever-increasing risks of fraudulent and counterfeit driving licenses.

“Considering the cost drivers of producing the driving license and the risk of fraud and corruption, the new driving license will continue to be manufactured centrally,” the department said.

The department embarked on a process to find a service provider with a tender advertisement in the government tender portal on 5 April 2023, which closed on 5 May 2023. 

This resulted in five bidders’ responses that were received and subjected to a thorough and transparent process of evaluation and adjudication by the bidding committee.

“It was also subjected to a probity/audit process - the probity conclusion being that all the processes were in compliance with prescribed legislation and policies,” the department said.

On 30 August 2022, Cabinet of the 6th administration approved a proposal by the department to produce a new driving license card for the country. – SAnews.gov.za
