EASTERN CAPE – The Mthatha based Serious Corruption Investigation team of the Hawks has secured the appearance of two former members of the Hawks, former Captain Given Makhubele and Jacob Tyantini, who are facing charges of corruption.
The accused appeared before the Mthatha Specialised Commercial Crimes Court on 3 September 2026 after being served with summons.
The matter stems from an alleged scheme in which a business owner was purportedly solicited for a substantial amount of money in exchange for the unlawful withdrawal and destruction of a criminal docket.
It is alleged that on 31 July 2023, the complainant received a telephone call from one of the accused, who allegedly introduced himself as a Hawks official from Gauteng and claimed to hold the rank of Captain. The suspect allegedly informed the complainant that the Department of Employment and Labour had opened a criminal case against his company and subsequently requested a meeting.
On 4 August 2023, the complainant ostensibly received a further communication from the same individual, during which an amount of R400 000 was demanded. The complainant reportedly indicated that he was unable to raise the demanded amount.
The alleged solicitation continued when, on 5 September 2023, the complainant was reportedly contacted again and a meeting in Mthatha was arranged. He was allegedly instructed to bring R50 000, purportedly in exchange for the destruction of the docket and the closure of the criminal case.
Unable to raise the full amount, the complainant managed to secure R10 000 and subsequently reported the matter to the Hawks. An operation was thereafter instituted by the investigating team, culminating in the arrest of the suspects immediately after the alleged transaction. Cash believed to be the money involved in the transaction was recovered in their possession.
The accused, both former members of the Hawks, initially appeared before the Mthatha Specialised Commercial Crimes Court on 8 September 2023. The matter was subsequently provisionally withdrawn against them pending further investigation.
Following the completion of further investigative processes, the accused were served with summons directing them to appear before court on 3 September 2026.
The matter was enrolled and subsequently postponed to 5 February 2027 for further proceedings. Both accused are out on warning.
