A Judicial Service Commission conduct committee has ordered KZN Judge Elsje-Marie Bezuidenhout to apologise in writing to litigants after taking nearly a year to provide reasons for a June 2024 urgent court order.
Deputy Chief Justice Dunstan Mlambo ruled that the delay breached the judicial code of conduct but found it did not warrant referral to a tribunal because it was not intentional.
The committee ruled that other allegations of bias, procedural unfairness and improper treatment of lawyers belonged in appeal proceedings not judicial misconduct processes.
