Illegal Eduan Park Guesthouse Served Immediate Cessation Order

The Freedom Front Plus (VF Plus) secured a victory for the residents of Eduan Park in the Polokwane Local Municipality during last week’s municipal planning hearing by obtaining a summary cessation order against an illegal guesthouse in the neighbourhood.

The party assisted the Eduan Park Community Forum and Mr Daniel Scholtz as formal objectors in the matter.

The party’s assistance ensured that the community’s grievances were submitted in compliance with the official framework of Polokwane’s Municipal Planning By-laws.

Mr. Scholtz presented key evidence of the disruption caused by the guesthouse on behalf of affected residents.

Evidence of traffic obstruction caused by buses and taxis, noise disturbances in the early morning hours and littering was also tabled to the panel.

Further evidence was presented proving that the guesthouse had been operating without the required zoning or licences for more than a year, while the title deed permits only residential use.

The chairperson of the panel cut short the submission by the applicant (guesthouse owner) after the extent of the ongoing legal contraventions came to light.

The panel ordered that all unlawful business activities must cease immediately and that the rezoning process is suspended pending finalisation of the application to remove title deed restrictions.

The Planning Division will now table its recommendation to the Municipal Council for approval.

The Freedom Front Plus recognises that development is essential for growth, but it should never be at the expense of the law or the character of established neighbourhoods.

Safeguarding residents’ rights and upholding municipal by-laws are non-negotiable.

By assisting citizens to follow the correct channels, the Freedom Front Plus ensures that the integrity of neighbourhoods such as Eduan Park is preserved and that authorities act within the constraints of transparent legislation.
