Olver's appointment to climate commission welcomed

The Presidential Climate Commission has welcomed the appointment of Dr Crispian Olver as the new deputy chairperson of the commission.

Olver’s appointment was announced by President Cyril Ramaphosa on Sunday.

He will take over the position from outgoing deputy chairperson, Valli Moosa, from January 2025.

Moosa said Olver will bring a “wealth of skills and expertise” and experience to the position.

“He has served in the first democratic government in various capacities and was instrumental in the early development of climate policy and environmental legislation, as well as the establishment of the local government system in South Africa.

“Collectively, as the commission, we congratulate Dr Olver in his new role and express our confidence in him to continue to strengthen the commission, particularly during this critical period as the PCC transitions into a public entity in terms of the Climate Change Act recently enacted by President Ramaphosa,” Moosa said.

Olver thanked President Ramaphosa for the expression of confidence through the appointment.

“As I take up this new responsibility, I want to express my thanks to the President for his vote of confidence, and importantly, the outgoing Deputy Chairperson, Mr Valli Moosa, who provided us with leadership and vision in the initial stages of the commission and positioning it as a highly transparent and engaging multi-stakeholder platform in the country’s climate action discourse.

“The PCC will continue to forge social dialogue and ensure that our country’s climate change response and just transition is inclusive and champions our socio-economic interest. In the same vein, I would like to encourage our social partners to continue to take a keen interest and actively participate in our work, so that we can build a just and inclusive society, together,” Olver said. – SAnews.gov.za

SA's cruise season officially underway

The docking of the World Odyssey at the Port of Cape Town signifies the beginning of South Africa’s cruise season, which will see the docking and sailing of 268 passenger liners at the commercial seaports operated by Transnet National Ports Authority (TNPA).

The vessel arrived on 22 October 2024 at the port renowned for being a popular stopover for cruise liners and was recently voted as Africa’s Leading Cruise Port in the 31st Annual World Travel Awards.

Sailing under the flag of the Bahamas, the World Odyssey cruise liner brought approximately 538 international tourists onboard, paving the way for a projected 130 000 tourists anticipated to visit Cape Town during this cruise season.

The 268 scheduled passenger liners, represents an increase of 29% from 207 call-ins in the previous year.

These vessels will pull along at seven South African commercial seaports, with Cape Town set to welcome 88 call-ins, 47 for Durban, 43 for Gqeberha, 27 for Mossel Bay, five for Saldanha, 14 each for Richards Bay and East London.

“The upsurge in the anticipated vessel call-ins this season supports the strategic positioning of South Africa’s ports as key drivers of economic growth and gateways for international trade.

“The cruise liner segment is one of the fastest-growing contributors to the country's GDP through tourism revenue. As TNPA, we look forward to collaborating with cruise tourism stakeholders to support the growth of the economy.

“Building on the success of the previous cruise season, TNPA continues to provide reliable marine services as well as creating berth capacity to enable an efficient cruise vessel service,” said Advocate Phyllis Difeto, the TNPA Acting Chief Executive.

TNPA anticipates that more vessels will be confirmed as the cruise season progresses.

TNPA is responsible for the safe, effective, and efficient economic functioning of the national port system, which it manages in a landlord capacity.

It provides port infrastructure and marine services at the eight commercial seaports in South Africa – Richards Bay, Durban, Saldanha, Cape Town, Port Elizabeth, East London, Mossel Bay and Ngqura.

It also operates within a legislative and regulatory environment and is governed by the National Ports Act (Act No. 12 of 2005). – SAnews.gov.za

Crispian Olver Appointed as New Deputy Chairperson of the Presidential Climate Commission

Location: News

The Presidency of the Republic of South Africa

President Cyril Ramaphosa has appointed Dr Crispian Olver as the new Deputy Chairperson of the Presidential Climate Commission (PCC), with effect from 1 November 2024. The position of the Deputy Chairperson was previously held by Mr Valli Moosa since its inception in December 2020 until his retirement earlier this year. Dr Olver served as the Executive Director of the PCC supporting Mr Moosa since the start of the Commission.

The PCC, which is chaired by President Ramaphosa, followed recommendations from the Presidential Jobs Summit in 2018 when social partners agreed to a creation of a multi-stakeholder body to coordinate and oversee the just transition towards a low-carbon, inclusive, climate change resilient economy and society. The Commission has since been enacted as a Schedule 3 A public entity with the signing of the Climate Change Act, by President Ramaphosa in July this year.

Dr Crispian Olver brings not only his experience in the PCC, but a wealth of skills and expertise. He served in the first democratic Government in various capacities, including as Director General of the Department of Environmental Affairs and Tourism (1999 – 2005), in which position he crafted much of the climate policy and environmental legislation, as well as leading South Africa's hosting of the World Summit on Sustainable Development (2002).

The President welcomes and congratulates Dr Olver in his new role and has urged him and the entire Commission to continue working towards forging social dialogue and engagement in ensuring that South Africa's climate change response and just transition is inclusive and champions socio-economic interest in pursuit of South Africa's global targets to address the climate crisis.

On behalf of the Commission, President Ramaphosa would like to thank the outgoing Deputy Chairperson, Mr Valli Moosa, for his relentless service and dedication to the Commission and for successfully steering it since its establishment in 2020.

Passing of former Minister Mdladlana another enormous loss for SA

Passing of former Minister Mdladlana another enormous loss for SA

Deputy President Paul Mashatile says the passing of former Labour Minister Membathisi Mdladlana has been an enormous loss not only for his family, but the country and the democratic movement.

“To those among us who have sipped from the well of his wisdom and insight, we extend our gratitude to his family for the grace of sharing him with us through both trials and triumphs,” Mashatile said.

The Deputy President was speaking at the Official Memorial Service held in the Western Cape on Saturday.

The later former Minister and High Commissioner to Canada, Mdladlana passed away on Friday, 18 October 2024, at the age of 72.

His family requested a private funeral which took place on Wednesday, 23 September 2024.

The Deputy President said on Saturday that in recent times, the country has had to part ways with many “guiding stars, companions, allies and cherished souls who have traversed the tumultuous journey to illuminate the way toward democracy”.

“They belonged to an illustrious generation of revolutionaries and servant leaders whose contribution to the liberation and development of South Africa remains immeasurable,” he said.

These stalwarts set themselves on a course to liberate South Africa from tyranny.

“What brings us solace and profound delight is that unlike many of their comrades, they have tasted the sweetness of freedom in their days. A tale I trust they shall weave upon reaching the other side, recounting to those who were not graced with such fortune to behold it.

“Those who have recently departed achieved their mission and fulfilled their personal destinies. yet their work, our work, is not yet complete. The South Africa of true equality for all is still to be fully realised,” the Deputy President said.

The Deputy President said the late Mdladlana was one of the leading lights in the struggle for liberation.

“He was the embodiment of resilience. His life provided a lesson in the true nature of social justice, that one must seek for others what you seek for yourself. He understood that a thriving economy depends on the well-being of its workers. He fought to ensure that South Africa’s workforce received fair treatment and protection under the law.

“During his tenure, he fully implemented the Basic Conditions of Employment Act of 1997, one of the most significant pieces of legislation. This Act guaranteed fair working hours, decent wages and safeguards against exploitation for workers,” Deputy President Mashatile said.

Mdladlana was an activist, a unionist, and a leader who was able to transcend an unjust system.

“He did it not for his own personal gain but for the benefit and improvement of others. He always reiterated the rallying cry that an injury to one is an injury to all,” Mashatile said.

He said Mdladlana walked by faith rather than sight as stated in the great book.

“He hoped and believed that South Africa would one day be free and certainly it is today.” – SAnews.gov.za

Home Affairs Chairperson Reminds People to Contribute to Electoral Reform Panel Call for Public Submissions

The Chairperson of Portfolio Committee on Home Affairs, Mr Mosa Chabane, has called on the public, political parties and prospective independent candidates to effectively contribute by making public comments to the Electoral Reform Consultation Panel by 31 October 2024.

The panel has extended its deadline to 31 October following a request by the committee to enable extensive public participation in its process to assess electoral systems and recommend an appropriate system for the country. “Public participation is enshrined in the Constitution because of the need for informed decision-making. By making submissions, South Africans will be contributing to shaping South Africa's constitutional trajectory going forward,” Mr Chabane said.

The Electoral Reform Consultation Panel is a critical body that was established to examine the current electoral system and many others across the world, as per section 23 (9) (b) of the Electoral Amendment Act of 2023.

It is important therefore, according to Mr Chabane, that as the panel continues its work it is supported effectively. “South Africans cannot abdicate the responsibility to jointly build and develop our constitutional democracy. We owe it to ourselves, gallant freedom fighters that fought for our liberation and future generations to make meaningful contribution to this new phase in our democratic dispensation,” Mr Chabane concluded.

The submissions can send by email to: ERCP@dha.gov.za or hand delivered to House 1, Ministry of Home Affairs, 909 Arcadia Street, Hatfield, Pretoria. Alternatively, the submissions can be delivered by hand to the nearest Home Affairs Office.

Committee on Health Resolves to Continue With Public Hearing on Tobacco Bill

Location: News

Republic of South Africa: The Parliament

The Portfolio Committee on Health has resolved, after receiving a legal opinion, to continue with its programme, which among other things includes public hearings on the Tobacco Products and Electronic Delivery Systems.

The decision was made after the committee received a legal opinion from Parliament's Legal Services division. The legal opinion stated that while NEDLAC has an internal protocol for considering matters, the NEDLAC Act does not prescribe a specific process that must be followed. It also noted that NEDLAC is empowered to continue engaging on the bill even after it has been introduced in Parliament.

Committee Chairperson Dr Sibongiseni Dhlomo said, “The legal opinion has provided clarity on the consultation process and we are satisfied that the Department of Health has met the necessary requirements. As a committee, we are now ready to proceed with the remaining public hearings and continue our consideration of the bill.”

The committee had previously conducted public hearings in seven of the nine provinces during the 6th Parliament. The committee will continue with remain two provinces, Northern Cape and KwaZulu-Natal.

Dr Dhlomo said he had written to NEDLAC and had a discussion with the council's director to ensure open communication and address any outstanding concerns. “We are committed to a transparent and inclusive process, and we welcome further engagement with NEDLAC as we finalise our consideration of this important legislation,” he said.

Four provinces declared free from Foot and Mouth Disease outbreaks

Location: News

Four provinces declared free from Foot and Mouth Disease outbreaks

The Department of Agriculture has announced that the Foot and Mouth Disease (FMD) outbreak, which occurred during 2021-2022, has been successfully resolved in the North West, Free State, Gauteng and Mpumalanga provinces.

These provinces, which were initially impacted by the outbreak, have now completed comprehensive testing of animals on quarantined farms.

The results indicate that the FMD virus is no longer present.

The World Organisation for Animal Health has confirmed that the outbreak in these regions has officially been closed.

However, the department said, it is important to note that the KwaZulu-Natal and Eastern Cape provinces remain affected by FMD outbreaks.

“Encouragingly, no new signs of the disease have been reported in these two provinces over the past month,” the department said.

The Minister of Agriculture, John Steenhuisen, has extended his gratitude to all stakeholders for adhering to control measures, which helped prevent the further spread of the disease.

“The cooperative efforts of all role players have been instrumental in managing this outbreak and safeguarding the country's livestock industry,” the Department of Agriculture said in a statement.

FMD in the Eastern Cape

In the Humansdorp area, 37 farms have now been confirmed positive for FMD, while a further 38 farms were pre-emptively vaccinated to prevent further spreading of the disease.

Since the onset of the outbreak, approximately 130 000 animals have been vaccinated across the province.

Farms that are either infected or vaccinated remain under quarantine, with animal movements restricted. Movement from these farms is only permitted for direct slaughter, with State Veterinary approval.

Farm owners are required to enforce strict biosecurity measures to prevent the disease from spreading through animals, vehicles, equipment or people.

On 26 July 2024, the department declared an FMD Disease Management Area (DMA), covering parts of the Kouga and Kou-Kamma Municipalities. Animal movements into, through, within or out of this area are strictly controlled and require State Veterinary permission.

Farms within the DMA must be inspected, tested and declared free of the disease before any animals are allowed to move.

Four affected farms located on the borders of the DMA were placed under quarantine and as a result, pose no risk of cattle movement. Surveillance around these farms has been concluded, and no further spread has been detected outside the DMA.

“The department is actively collaborating with law enforcement and Agri-Eastern Cape to investigate reports of illegal animal movements. Those found in breach of quarantine or DMA restrictions will face legal consequences.

"The public is urged to report any information regarding illegal movements or breaches of biosecurity,” the department said.

In East London, the FMD outbreak has been successfully contained. The department has extended its gratitude to the affected farmers in the area for their vigilance and cooperation.

Animals on these farms are being slaughtered in a controlled manner at designated abattoirs, ensuring that FMD risk materials are properly processed or disposed of.

Only safe products are released into the local market. While meat from FMD-restricted farms cannot be exported due to certification limitations, it remains safe for human consumption.

The Director of Animal Health has designated three abattoirs to handle the slaughter of cloven-hoofed animals from FMD-quarantined farms. Seventeen farms have been granted permission for controlled slaughter at these abattoirs.

Ahead of the festive season, the department has urged holidaymakers visiting the affected areas to be mindful of the biosecurity measures in place.

“Please avoid entering affected farms, which remain under quarantine. No live animals or animal products are permitted to move off these farms,” it said.

In addition to the control measures within the DMA in the Eastern Cape, the July 2024 Gazette Notice stipulates that cloven-hoofed livestock across South Africa may only be moved if accompanied by a health declaration from the owner, attesting to the animals' health at the time of movement.

While this has been a legal requirement since October 2022, its importance is being reiterated to prevent the further spread of FMD.

The department has advised all livestock farmers nationwide to limit animal movement as much as possible. Cloven-hoofed animals should not be moved unless absolutely necessary.

“Limiting movement provides an opportunity to identify and quarantine further undetected, affected properties, thus preventing any further spread of the disease.

“The significance of the incubation period for FMD cannot be overstated. During this period, animals may appear healthy while shedding the virus and not yet displaying clinical signs of the disease.

“Farmers are again urged to observe stringent biosecurity measures on their farms to protect their herds from infection. Section 11 of the Animal Diseases Act imposes a legal duty on animal owners or managers to take all reasonable steps to prevent their animals from becoming infected and to prevent the spread of any disease from their animals or land to others,” the department said.

Biosecurity measures include:

  • Any cattle, sheep, or goats newly introduced to a farm must be kept separate from resident herds for at least 28 days.
  • Only introduce animals accompanied by a health declaration from known clean farms.
  • Prevent nose-to-nose contact between farm animals and animals outside the farm.
  • Maintain secure farm boundaries and restrict access for people and vehicles as much as possible.
  • Ensure that farm personnel have no contact with animals outside the property.
  • Provide clean clothing and washing facilities for all visitors and personnel, and ensure thorough cleaning and disinfection of any vehicles and farming implements brought onto a property.
  • Regularly consult with the responsible private and State Veterinarian, and animal health technician to refine biosecurity measures.

Any suspicious clinical symptoms, such as salivation, blisters in the mouth, limping or hoof lesions should be reported immediately to the local State Veterinarian and such animals must not be moved under any circumstances. – SAnews.gov.za

“Government recognises and supports the critical role of traditional leadership institutions in South Africa’s constitutional democracy and communities, especially in relation to prioritising development in rural and traditional areas,” CoGTA said.

According to the department, the recognition of kings, queens and principal traditional leaders is regulated by sec 7 (1)(a) (i) and (ii) of the Traditional and Khoi-San Leadership Act No 3 of 2019 (the TKLA).

Kings, queens and principal traditional leaders have a customary role to play as leaders of traditional communities.  They also have a role in nation-building and social cohesion through the promotion of peace, stability and unity within the traditional communities under their jurisdiction.

Furthermore, the department explained that the establishment of a Forum of South African Majesties will ensure a continuous interface between Their Majesties and government, in aid of seamless coordination, particularly on issues of mutual interest and inclusive development.

“The institution of traditional leadership continues to serve as a reliable and valuable compass of society and the development of the nation.

“The engagement will receive progress reports from government on matters raised previously by Their Majesties, ranging from land reform, rural infrastructure, socio-economic development, as well as the preservation of culture and heritage, among others,” the department said. – SAnews.gov.za

Gender equality remains key in climate change adaptation

Gender equality remains key in climate change adaptation

Government has affirmed its commitment to addressing gender equality in relation to women being disproportionately affected by the impacts of climate change through policy, legislation and action.

Addressing the Climate Change Adaptation and Gender Mainstreaming Dialogue in Pretoria, Deputy Minister of Forestry, Fisheries and the Environment, Bernice Swarts, said the increased burden on women necessitates that government makes gender equality a central tenet of the climate change strategies.

“Our National Climate Change Response White Paper explicitly recognises the special needs and circumstances of rural women, who are among the hardest hit by climate change.

“Gender mainstreaming is not just a theoretical concept but a practical necessity. It means integrating gender considerations into all aspects of climate change adaptation strategies, policies, and programmes.

“By doing so, we ensure that the unique experiences and contributions of women are not only recognised but are also harnessed in ways that promote sustainable development,” the Deputy Minister said on Wednesday.

She said the National Environmental Management Act (NEMA) acknowledges the vital role of women in environmental management.

“However, we must do more than just acknowledge: we must act! It is through inclusive approaches that we can begin to build resilience, reduce vulnerabilities, and address the inequalities that climate change exacerbates.

“While we have made progress in establishing gender-sensitive policies, the challenge lies in effectively implementing these policies on the ground. We must continue to share best practices, success stories, and innovative approaches that have worked in different sectors and regions,” Swarts said.

The Deputy Minister noted that gender inequality has long been a global issue.

“Despite efforts to address these inequalities through international frameworks like the United Nations Charter, the Universal Declaration of Human Rights, and the Beijing Declaration and Platform for Action, the reality is that many women, especially in developing nations, remain disproportionately affected by the impacts of climate change.

“Women, particularly those in rural areas, are among the most vulnerable when climate disasters strike. They often face greater challenges accessing resources such as water and food due to droughts, floods, and other extreme weather events,” Swarts said. -SAnews.gov.za

Designation research studies underway to strengthen local production and content

Designation research studies are underway to strengthen the role of local production and content in the South African public procurement system, says Chief Director of Industrial Procurement and Development at the Department of Trade, Industry and Competition (the dtic).

Makube on Tuesday made a presentation at the 11th Manufacturing Indaba Conference and Exhibition in Johannesburg.

The Manufacturing Indaba is an annual event in South Africa that brings together key stakeholders from the manufacturing sector, including business leaders, government representatives, investors, and industry experts.

Its purpose is to foster growth, collaboration and innovation in the manufacturing industry, providing a platform for discussion on challenges, opportunities and policy frameworks.

The event aims to enhance industrialisation, drive economic growth and promote sustainable practices in manufacturing across the continent.

Makube’s presentation, which focused on “Localisation in the Public Procurement System”, highlighted key areas where policy adjustments could better support South Africa's economic growth, emphasising the strategic importance of localisation in stimulating the local economy by leveraging public sector expenditure.

He provided a comprehensive analysis of the current economic landscape, underscoring the importance of targeted interventions to drive growth.

"It is crucial that we intervene strategically in the economy by being deliberate about our procurement and purchasing choices. This requires rigorous economic analysis.

"While South Africa faces challenges in achieving the growth rates outlined in the National Development Plan, efforts to strengthen the localisation framework are essential.

“We need to address structural challenges in our economy, such as the declining manufacturing value addition to gross domestic product (GDP), high unemployment rates and scaling up export growth that will ensure sustainable economic development,” Makube said.

He emphasised the potential for localisation to drive economic multipliers, such as job creation and industrial development through strategic procurement.

Local production, particularly in sectors like manufacturing, can significantly enhance South Africa’s economic resilience.

“Manufacturing has historically been a key contributor to the GDP product, and we need to revive its role by focusing on sectors where we have a competitive advantage.

“Public procurement serves as a powerful tool to achieve this by prioritising South African-made goods and services. Such measures would help address issues related to South Africa’s reliance on imports and support government's broader economic transformation agenda,” Makube said.

Looking ahead, Makube highlighted the dtic's commitment to fostering a fair, transparent and competitive public procurement environment that benefits local producers and suppliers. He noted that recent legislative developments, such as the development of the Public Procurement Act, offer new opportunities for supporting local industries.

“Our goal is to ensure that procurement processes not only meet constitutional requirements but also contribute to building a stronger local economy.

“By enhancing transparency and competitiveness, we can create a more inclusive market that benefits all South Africans, especially those previously excluded from economic participation,” Makube said. – SAnews.gov.za

Deputy President to convene second meeting of the GNU clearing house mechanism

Deputy President Paul Mashatile will convene the second meeting of the Government of National Unity (GNU) clearing house mechanism on Thursday, 24 October 2024.

The Deputy President chaired the first virtual meeting last week, which the Presidency said got off to a good start.

READ | Inaugural meeting of the GNU clearing house gets off to a good start

The GNU clearing house mechanism is a platform created by President Cyril Ramaphosa to resolve policy disagreements and disputes within the GNU.

All 10 political parties that are signatories to the GNU – African National Congress, Democratic Alliance, Patriotic Alliance, Inkatha Freedom Party, Good Party, Pan Africanist Congress of Azania, Freedom Front Plus, United Democratic Movement, Al Jama-ah, and Rise Mzansi have been invited.

The Office of the Deputy President serves as the Secretariat of the GNU clearing house mechanism.

Issues to be discussed include the clearing house mechanism's terms of reference and an update on the preparations for the G20 Summit.

The leaders will also touch on the aspects of the Basic Education Laws Amendment Act (BELA Act), update on the preparations for the National Dialogue, and discuss challenges at the provincial and local government level in relation to coalition governments.

The mechanism will not override Cabinet decisions, as the Executive remains the final decision-making body in government. However, it will ensure that all GNU signatories develop a common understanding of critical policy matters.

In addition to the mechanism, the Presidency said it was resolved to establish a technical committee to serve as a processing channel for matters of divergence within the GNU.

This means that this mechanism will establish the Political Leaders’ Forum of parties who signed the statement of intent. – SAnews.gov.za

The SIU welcomes the arrest of former Transnet CEO

The SIU welcomes the arrest of former Transnet CEO

The Special Investigating Unit (SIU) welcomes the arrest and court appearance of former Transnet Group Capital (TGC) Chief Executive Officer Herbert Msagala.

He appeared before the Johannesburg Specialised Commercial Crime Court on fraud, corruption, theft and money laundering charges.

Following his first appearance, Msagala was granted R60 000 bail.

The arrest and court appearance follows a thorough investigation by the SIU, which uncovered that Msagala unduly benefited from kickbacks worth over R26 million from IGS Consulting Engineering, which he allegedly used to purchase properties and vehicles.

The SIU's investigations focused on contracts totalling over R194 million that TGC awarded to IGS Consulting Engineering.

These contracts were related to maintaining and upgrading high-pressure pipeline infrastructure as part of the New Multi-Product Pipeline project, which transports various fuel products from Durban to Gauteng.

Msagala improperly benefited from kickbacks exceeding R26 million from IGS Consulting Engineering. The SIU investigated under the authorisation of Proclamation No. 11 of 2018.

In line with the Special Investigating Units and Special Tribunals Act (SIU Act), where the SIU finds possible criminal evidence, it must refer the evidence to the National Prosecuting Authority for further action.

In 2020, the SIU made criminal referrals against Msagala and others, which led to him being charged alongside two individuals and IGS Consulting Engineering being charged as an entity. While the individuals are yet to appear in court, the Directorate for Priority Crime Investigation (Hawks) is actively tracing their whereabouts.

In July 2020, the SIU obtained a preservation order from the Special Tribunal to preserve Msagala’s pension benefits and assets. The assets included 35 luxury vehicles and five properties, which comprised two farms and houses in gated estates, valued at over R18 million.

Msagala attempted to overturn the order but lost his appeal in November of that year. As a result, his properties and pension fund have been forfeited to the State.

The SIU is authorised, under the SIU Act, to initiate a civil action in the High Court or a Special Tribunal in its name to address any wrongdoing identified during its investigation resulting from acts of corruption, fraud or maladministration.

The criminal case has been postponed to 19 November 2024, to allow for further investigations and to trace the outstanding suspects.

The SIU will continue to support the prosecutorial process and ensure that all individuals implicated in corruption are brought to justice by the law.

The prosecution of Msagala is part of implementing the National Anti-Corruption Strategy, which sees law enforcement agencies coming together to eradicate corruption in South Africa and ensure the continued cleaning up of government departments from corruption. – SAnews.gov.za

Africa urged to act now against climate change

Africa urged to act now against climate change

With climate-driven events such as droughts and floods disrupting agricultural production across the continent, and leading to increasing food insecurity, government has called on the Southern African Development Community (SADC) to act now against climate change.

“To counter this, it is essential to promote sustainable agricultural practices, improve irrigation systems, invest in agricultural research and technology, and develop resilient crop varieties,” Deputy Minister of Forestry, Fisheries and the Environment, Narend Singh, said on Wednesday in Durban.

He pointed out that Africa’s reliance on natural resources, rain-fed agriculture, and inadequate infrastructure makes it particularly vulnerable to the impacts of climate change.

The Deputy Minister was addressing the Environmental Assessment Practitioners Association of South Africa (EAPASA) Regional Conference, which is taking place under the theme: "SADC Sustainable  Synergies".

Singh said integrated environmental management and social tools provide a comprehensive framework for sustainable development, one that balances economic growth, environmental conservation and social equity.

“This integrated approach is vital for addressing the many environmental challenges our continent faces, while simultaneously promoting inclusive growth and resilience. By embracing this method, we ensure that development is not only sustainable but also equitable, benefiting both present and future generations.

“The time to act is now. The environmental challenges we face do not respect borders or timelines, and every day we delay, the cost to our region and our people increases.

“As we transition our key economic sectors towards low carbon, climate resilient and a just society, it is important that our strategic, integrated and environmental impact assessments pay attention to the balance in social, economic and environmental aspects of sustainable development path and ultimately the achievement of our Nationally Determined Contribution (NDC),” the Deputy Minister said.

He emphasised the importance of prioritising a sustainable just transition path that pays attention to addressing the challenges of poverty, unemployment and inequality.

South Africa’s just transition path

He said South Africa’s Just Energy Transition (JET) programme has emerged as a crucial response to the climate crisis, setting an ambitious course for the nation to shift away from coal, while building a low-carbon, climate-resilient economy.

“The JET programme has already made strides in diversifying our energy mix by investing in renewable energy sectors such as solar, wind, and green hydrogen.

“We have closed some coal plants and retrained workers, ensuring that the transition is just and inclusive. This transformation is more than just an energy strategy; it is a fundamental reimagining of our future, one that presents profound opportunities for collaboration with SADC countries.

“By working together on cross-border energy projects, technology sharing, and capacity building, we can build a united front that not only mitigates climate change but also spurs economic growth and energy security across the region,” the Deputy Minister said.

He touched on the significance of regional cooperation, which is essential in the quest to balance environmental sustainability with economic development.

“This year marks six years since the Department of Forestry, Fisheries, and the Environment appointed EAPASA as the sole registration authority under Section 24H of the National Environmental Management Act (NEMA).

“It is truly remarkable to witness how, in just six years, this young organization has successfully convened SADC members for the third time in such a short period. This achievement speaks to the tremendous commitment to our region and the greater cause of environmental stewardship.

“As we implement our individual laws and regulations, we must remain mindful that our true success will be measured by how well we collaborate. I urge you to envision the SADC region as a unified entity, one where our systems are integrated and harmonised to enable development that benefits not only our generation but those to come,” the Deputy Minister said. - SAnews.gov.za

National Treasury explains details of GFECRA settlement agreement

National Treasury explains details of GFECRA settlement agreement

The National Treasury has sought to clarify the details of the Gold and Foreign Exchange Contingency Reserve Account's (GFECRA) new settlement agreement.

In the 2024 Budget Review, Treasury announced a reform to the settlement framework for the GFECRA.

The Minister of Finance and the Governor of the South African Reserve Bank (SARB) signed a new GFECRA settlement agreement in June 2024.

The agreement allocates funds across three “buckets,” with the first bucket being allocated to GFECRA to retain sufficient funds to absorb exchange rate swings.

“Failure to do so would create an obligation for the National Treasury to cover exchange rate losses. In terms of the agreement, a R250 billion distribution will be made from the GFECRA.

“Of this amount R100 billion was paid into a second bucket for the SARB contingency reserve account, to ensure the central bank’s solvency and to pay sterilisation costs to neutralise the interest rate impact,” National Treasury said on Tuesday.

The balance of R150 billion will be paid to the National Treasury in tranches of R100 billion (2024/25), R25 billion (2025/26) and R25 billion (2026/27).

“This will be used to reduce government’s borrowing and therefore the growth in the stock of debt. The impact of the GFECRA settlement on the budget was presented in Table 7.2 of the Budget Review – financing of national government gross borrowing requirement – and disclosed over the medium-term as a balance sheet transaction reducing the borrowing requirement.

“The treatment of the transaction will remain the same in the 2024 Medium Term Budget Policy Statement (MTBPS), as well as in future budget publications. The distribution from GFECRA (R250 billion) is recorded as a return on an investment, which is a balance sheet transaction.

“This is not recorded as revenue of government. Funds are paid from the SARB into governments bank account (the National Revenue Fund) and from this account the cash is used to pay government’s commitments and to provide for the contribution to the SARB contingency reserve account (as required in terms of GFECRA Defrayal Amendment Act, Act no 27 of 2024),” National Treasury said.

Flow of funds

To comply with both the requirements of the Public Finance Management Act (PFMA), Act no 1 of 1999 and the GFECRA Defrayal Amendment Act, Act no 27 of 2024, the flow of funds for the SARB contingency reserve account of R100 billion, requires a payment into and withdrawal from the National Revenue Fund (NRF – the bank account of government).

“However, this does not imply that the amount is recognised as revenue, as it remains a balance sheet flow. In other words, government converts the GFECRA investment into cash (in the NRF), which is then used to fund the SARB contingency reserve. All these transactions are recorded on the balance sheet.

“In the monthly Statement of National Governments’ Revenue, Expenditure and Borrowing published in terms of section 32 of the PFMA, the cash flow position of government is presented in tables 1 to 4 of the release.

“In these tables, which presents the flows into and withdrawals from the bank account (NRF) of government, the R200 billion received from the SARB is shown as Exchequer revenue (the cash receipt) and the payment to the SARB as a departmental requisition of R100 billion,” National Treasury said.

This means that R200 billion in cash from an investment was received into the bank account of government, of which R100 billion was requisitioned by the Department of the National Treasury to contribute to the SARB Contingency Reserve Account.

“The balance of R100 billion remains as a positive balance that is used to reduce the gross borrowing requirement. Reducing the borrowing requirement implies that government is using the cash to borrow less, as is required in terms of the GFECRA settlement agreement.

“The Budget of government is presented on the adjusted cash basis of accounting. Revenue and expenditure are recorded when transactions are initiated in the cashbook, in other words when a transaction is processed in the financial system,” National Treasury said.

The monthly budget comparable revenue and expenditure information is published in the summary statement of the section 32 report.

“This format mirrors the presentation of the 2024 Budget, which remains as the budget presentation for the 2024 MTBPS and future budget publications. In this table the cash flows of government are recorded as part of Changes in cash and other balances, which includes the net inflow of R100 billion (R200 billion in exchequer receipts less R100 billion in departmental requisitions) recorded in the cash flow statement.

“To ensure transparency in reporting the GFECRA settlement arrangement, the R100 billion set aside to reduce governments’ borrowing requirement is shown separately as part of the calculation of the gross borrowing requirement. This is in line with the presentation of the transaction at the time of the 2024 Budget, and this presentation format will remain both in the 2024 MTBPS and future budgets,” National Treasury said. - SAnews.gov.za

Eskom calls on prepaid customers to update meters before 24 November deadline

Eskom has urged prepaid electricity customers to recode their meters by 24 November 2024 as required by the Standard Transfer Specification Association (STSA).

According to Eskom, after this deadline, meters will no longer accept electricity tokens unless they are updated to key revision number (KRN) 2.

In response to recent reports, including one from City Power, Eskom confirmed that there will be no extension to the 24 November 2024 deadline for the token identifier (TID) update.

The recording process affects approximately 6.9 million prepaid meters in Eskom-supplied areas.

“Failure to recode by the deadline will prevent customers from loading electricity tokens, rendering their meters inoperable,” the State-owned power utility said on Monday.

The entity said it has already prepared 97% of the meters by pre-coding them, making it simple for customers to complete the process themselves.

“This do-it-yourself (DIY) process requires customers to purchase credit tokens from authorised vendors, after which they will receive two sets of 20-digit codes to enter into their meters for the update.”

Meanwhile, Eskom is intensifying its awareness campaign to ensure all customers are informed and encourages those who have not yet recoded their meters to act quickly to avoid service disruptions.

The utility also thanked those who have already completed the process and reassured customers that support teams are available for assistance.

“For more information, updates, and assistance, customers are encouraged to visit Eskom’s website, follow its social media platforms, listen to radio announcements, or participate in local engagement sessions.

“Eskom remains committed to a smooth transition to KRN2 and ensuring uninterrupted service for all customers.”

Europe’s Network and Information Security (NIS2) directive raises the stakes for African businesses to comply with European Union’s (EU) cyber security standards

Location: News
Check Point Software Technologies Ltd.

The European Union's NIS2 cyber security  directive has significant implications for African businesses trading with the continent.  This is according to Check Point Software Technologies (www.CheckPoint.com), a leading AI-powered cloud-delivered cyber security provider, which urges African businesses with strong ties to the EU to take steps to comply with this new, stringent cyber security regulation.

Download document: https://apo-opa.co/3UgCQYj

The European Union's NIS2 Directive, came into effect this month and requires member states to amend their national legislation. The NIS2 Directive imposes strict cyber security requirements, including enhanced management liability, reporting to authorities, risk management, and business continuity planning, placing African companies trading with the EU under increased scrutiny.

The NIS2 Directive builds upon the original NIS1 Directive introduced in 2016, expanding its scope to cover a wider range of sectors including Energy, Banking, Transport, Digital Infrastructure, Healthcare, Food Production, and Research. More than 80% of European enterprises are now within the scope of this legislation, which extends to global supply chain partners—including many businesses in Africa.

Collins Emadau, Check Point Partner and Director at Westcon, explains, “Europe is still Africa's leading trading partner. African businesses, particularly in leading economies such as South Africa, Kenya, and Nigeria, need to understand the far-reaching impact of NIS2. Compliance is not just about meeting EU standards—it's about securing their future in a globalised market. Failure to comply will result in not only heavy fines but also the potential loss of critical trade partnerships with EU member states."

What's at Stake for African Businesses?

The EU remains the largest trading partner for Africa, with over 18 Economic Partnership Agreements and trade worth billions annually. African businesses, especially in sectors like Energy, Banking, Transport, and Manufacturing, are key partners in the EU's supply chains. To continue doing business with EU companies, African organisations must comply with NIS2, which mandates strict cyber security measures to protect critical infrastructure and supply chains.

Issam El Haddioui, Head of Security Sales Engineering:  Africa, Check Point Software Technologies, says, "NIS2 sets a new standard for cyber security, and African businesses must act now. Many organisations are unaware of the depth of these requirements, which go beyond local regulations. Compliance is essential not only for maintaining business relationships with the EU but also for enhancing the overall resilience of African economies against cyber threats."

Compliance will exact a cost for African organisations, which according to Interpol's 2021 Africa Cyberthreat Assessment Report, spends an average of only 0.05% of their revenue on cyber security, far below the global average of 0.3-0.5%.  The Report also estimated the financial impact of cyber crime in the region at over $4 billion USD, representing about 10 percent of Africa's total GDP.

Tougher Penalties and Personal Responsibility

NIS2 introduces personal liability for business leaders in the event of a cyber attack, meaning that executives themselves can be held financially accountable for breaches. Penalties include fines of up to EUR 7 million or 1.4% of a company's global annual turnover, whichever is higher. This goes beyond the GDPR, placing even more responsibility on corporate leadership to ensure robust cyber security practices are in place.

NIS2 mandates that organisations must report cyber incidents to authorities promptly and inform their stakeholders, suppliers, and customers. Therefore, African businesses must ensure they have a comprehensive incident response plan in place, along with regular cyber security training for both IT and leadership teams.

Steps for African Businesses to Ensure Compliance

To successfully implement NIS2 and avoid devastating penalties, Check Point recommends the following four steps for African businesses:

  1. Knowledge: Business leaders must gain a basic understanding of cyber security to effectively communicate with their IT teams and ensure sound decision-making.
  2. People: Establish an agile IT security department, including key roles such as a Data Protection Officer (DPO) and a Chief Information Security Officer (CISO), to manage and distribute responsibilities efficiently.
  3. Audit: Conduct regular risk assessments and audits to identify and mitigate vulnerabilities. Continuous monitoring is essential to stay compliant with evolving threats.
  4. Incident Management: Develop clear procedures for responding to cyber incidents, including swift reporting to national authorities, suppliers, and stakeholders.

Long-Term Commitment to Cyber Security

Compliance with NIS2 is not a one-time process; it requires a long-term commitment to cyber security. From 2028, organisations will be required to annually document their NIS2-compliant IT infrastructure and demonstrate that their cyber security measures are aligned with the latest technological advancements.

“African countries, especially economic leaders like South Africa, Kenya, and Nigeria, should also consider using the NIS2 framework as a model for strengthening their own national cyber security regulations. By improving cyber-readiness, African businesses can not only comply with international standards but also protect their data, operations, and reputations from evolving threats,” El Haddioui continues.

El Haddioui, concludes, "The NIS2 Directive marks a significant shift in the cyber security landscape. African business leaders must recognise that cyber security is now a matter of survival, not just compliance. By taking proactive measures, they can safeguard their future, avoid heavy penalties, and ensure their organisations thrive in an increasingly interconnected global economy."

Committee Supports PPRA Court Action Against Counter Transformative Trend of HOA Charging

Location: News

Republic of South Africa: The Parliament

The Portfolio Committee on Human Settlements highlighted its support in a court action brought by the Residential Communities' Council (RCC) and the Association of Residential Communities (ARC) against the Property Practitioners Regulatory Authority (PPRA) challenging regulation 35 of the Property Practitioners Act.

The court action seeks an order declaring that charging estate agents fees to market and/or sell property within these estates does not constitute an undesirable business practice.

The Chairperson of the committee, Mr Nocks Seabi, said: “We cannot continue to play lip service to the issue of transformation within the property practitioners environment and the continued charging of these fees runs counter to the transformation agenda intended by the passing of the Property Practitioners Act. The committee was also of the view that these estate agents' fees effectively excludes or disadvantages property practitioners not party to these arrangements from proving services within such property developments,”

In line with the drive to ensure transformation within the real estate sector, the committee welcomed the public private collaboration between PPRA and Rawson Property Group that saw the awarding of 100 franchises to previously disadvantaged individuals. The committee is of the view that PPRA must leverage expertise and resources through such partnerships to accelerate progress towards complete transformation of the sector.

The committee also welcomed the general improvement in attainment of performance targets at PPRA. The entity improved its performance from 33% in the 2022/23 financial year to 66,67% in the 2023/24 financial year. Despite this, the committee urged the entity to resolve the matters of emphasis as identified by the auditor general and to ensure a positive audit outcome.

Meanwhile, the committee welcomed the unqualified audit opinion achieved by the Housing Development Agency as well as the achievement of 91% of its planned performance targets for the 2023/24 financial year. The remarkable turnaround at the HDA should be appreciated especially the reduction of irregular expenditure by over 90% of the financial year. “The commitment to good governance practices and strong internal controls are the bedrock upon which a functional entity rests upon,” Mr Seabi said.

The committee also welcomed the over achievements in the performance that includes the acquiring of 316 2926 hectares of land for housing purposes, delivery of 2142 serviced sites (against the target 1236) and 2402 title deeds.

With regards to the Social Housing Regulatory Authority (SHRA), the committee welcomed the attainment of an unqualified audit for the 2023/24 financial year, it raised concerns that of the 9 targets not achieved, a majority of the targets related to issues of transformation. Although the committee acknowledged the strides made by SHRA to facilitate the transformation agenda, it has called for maximised collaboration with stakeholders to ensure that the capacitation workshops be held to improve procurement within designated groups.

Despite this, the committee appreciated that the entity is already hard at work to address audit findings to ensure that the entity returns to previous positive findings.

The committee will continue to monitor the effectiveness of entities within the sector to ensure that they achieve set targets and ensure quality service delivery to the people.

SIU ramps up investigation into Dawid Kruiper Municipality

SIU ramps up investigation into Dawid Kruiper Municipality

The Special Investigating Unit (SIU), together with the South African Police Service and the Hawks, have conducted a search and seizure at the Dawid Kruiper Municipality in the Northern Cape.

This is in relation to a proclamation authorising the unit to investigate allegations of serious maladministration at the municipality related to the awarding of 24 contracts.

“The SIU and Hawks collected all payment documentation, which included confirmation of goods/services received, requisition forms, purchase orders, remittance advice, payment vouchers, reconciliation reports, monthly statements from service providers, and deviation forms captured from 1 January 2010 to September 2024, as stipulated in Proclamation 185 of 2024.

“Furthermore, the SIU has collected electronic items such as laptops, computers, mobile devices, optical media (DVD/CD), audio recorders, computer data storage mediums, external hard drives, memory sticks, and cards,” the SIU said.

On Thursday, the Upington Magistrate’s Court granted the corruption-busting unit a warrant to search for evidence at the municipality.

“The SIU has a reason to believe that a normal route of requesting information and documents would not have yielded positive results, hence it was deemed necessary to approach the Upington Magistrate Court for a search warrant to seize documents and computers to assist with the ongoing investigation.

“The Special Investigating Units and Special Tribunals Act 74 of 1996 (SIU Act) empowers the SIU to subpoena bank statements and cell phone records, search and seize evidence, and interrogate witnesses under oath to investigate allegations brought before it thoroughly,” the unit said. – SAnews.gov.za
